I-184 Affadavit of Support

My wife came to the USA and we are now married as of 11/9/08. I am completing the I-184, Affadavit of Support, for our AOS package and I am confused if I am supposed to complete the form as if we are not yet married using her maiden name instead of her married name.

Part 5 of the I-184 asks if I am currently married but if I answer yes it will show my wife as being counted twice.

Anyone who has had experince with this form please let us know. Your input will be appreciated!

We filed using the married name.

When we filed for AOS, I (the USC) used my maiden name (as I have not yet changed my name)...I can not remember what else I filled in (as it was a few months back) but I used the samples as a guide.

Have you looked at these sample forms? There is one for the I-184 if you scroll down.

07/20/07 confirmed delivered by US Postal Service

8/23/07 No NOA1 !!!!

8/23/07 phoned USCIS (told they can't help until after 90 days)

8/23/07 contacted bank to get copy of Cx check...illegable...noc WAC#

tried for weeks to get actual check....not possible, had to wait the 90 days for info from USCIS

10/17/07 Phoned USCIS, got thru (!), got WAC number and NOA1 date!!!!

07/26/07 NOA1 (never recieved hard copy, was promised a copy would be sent)

11/01/07 Ordered copy of "long form" UK B.C.

11/05/07 Recieved B.C. (Wish USCIS was that fast!)

11/09/07 Submitted request for UK police records

12/04/07 APPROVED By USCIS NOA2 letter sent (or so they claim)

12/15/07 Police certificate recieved

12/28/07 Called NVC, not in system

01/04/08 petition forwarded to London

01/12/08 packet 3 received *rubs eye in disbelief* Speed and efficiency, can it be?

01/18/08 HARD COPY OF NOA2 ARRIVED...seems the snail made a wrong turn somewhere.

01/28/08 Returned packet 3 to London Embassy

02/12/08 Medical completed...no problem.

02/13/08 Packet 4 received from London Embassy

03/03/08 Embassy Interview

03/06/08 Visa Arrived....Lovely to finally see it even if it is a bit drab...after 8 month you think they'd have sprung for some gold foil or at least a COLOR photo?

TODAY...he's here! He's in the US! Hurrah!

Congratulations! Best of luck to you both too! Things have moved along pretty quickly for us during AOS...the K-1 was the worst of it so far... after that we were really dreading the AOS paperwork...sounds like you were too!

You should use the exact same name (and version of the name if there are any) on every form you file with the AOS process. I read that on "tips for filing" on the USCIS website. So whatever name you use for her on AOS should be used for EAD, AP, and Affidavit of Support. That's I-864, not the number you said in your post.

The I-864 is one of those generic forms that covers adjustment from many visas and also people who are co-sponsoring. So yes, a co-sponsor may be filing for the person named in the first part, but also have his own wife or kids to count in his family total. I put "1" for the person I am sponsoring (my husband) in the first line and nothing else, including the "are you married" box so it would come out to a total of 2 person household. I think that will work since this form is about household size and income, not if you got married details.

I know this is an old post but i'm trying to get the best answer of my question, I came to US by K1 visa and got married within 90 days. I'm having trouble with my name, I just have one single name in my passport and birth certificate and when i asked for marriage license the recorder just wrote my single name, i want to change my name (use my christian name which is written my baptizing letter as my first name, my single name as my middle name and my husband last name as my last name). My question is can i file my AOS, i-184 and other forms with the name that i want to have even i just have my one single name in my marriage certificate?. What is the best way for me to do with this problem?. Thank you in advance.
