Hello everyone!

My wife and step son have been here with me and are holding a conditional green card. The green card will expire on 2/10/ 2009. I am in the process of applying for removal of conditions. My step son has turned 18 last August.

1. Do we need to file a separate petitionm for him?

2. in part B of the form (Basis for petition) - what answer should we mark? there are 7 options and I think it should be answer #B but not sure.

3. If we do need to file separately for him, can we still send the 2 petitions together in one envelope and share the same evidence documents, or do we need to send his petition totally separate from hers with his own evidence?

if he is under the age of 21 and his greencard was approved within 90 days of the parent's, then you can remove conditions together on one form for one fee... (only plus biometrics I think..)

"A" if together, "B" if separate

if you file separate you can send together in one envelope but the fee payment needs to be separate

Here are links that clearly states if your child ( Child of the PR ) received Conditional status within 90 days of the parent ( Date is on the GC ) then they are eligible to apply under tha same petition for just the Biometerics fee. If the conditional status was after 90 days of the parent then they child/ren must submit their own application

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )

4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png
