Hello!

I am gathering the info needed to file for my husband's AOS. We got married in August after he arrived with his K-1 visa. I know we are applying late but it has taken a while to get the money together. Anyway - that is not my concern. I am wondering if we need to fill out the EAD paperwork or is it moot now that we are filing late. Do we have to wait for his final approval for him to work?

moot?... if you need/want the interim benefit then it is not moot, and by all means apply for it......

moot?... if you need/want the interim benefit then it is not moot, and by all means apply for it......

Ok Thanks.. I read on page 4 of the USCIS instructions "file your EAD application if you are filing qith 90 days from the date of entry" (http://www.uscis.gov/files/form/I-765instr.pdf)

I could just be confused.

only true if you are filing based on K-1 before AOS (category A6)

since you are applying with or after AOS it will be based on category C9

For one you aren't filing late. File the I-131 and I-765 with the I-485. No cost.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

For one you aren't filing late. File the I-131 and I-765 with the I-485. No cost.

Thanks! .. don't need to the I-131... we won't be going anywhere to soon.

For your sake I hope you have a good glass ball. I've seen many peeps posting how to get an emergency AP. Unless your glass ball is hot you can't tell how long it takes for AOS. Some are still waiting after a year.
