OTTAWA (Reuters) – Obese people have the right to two seats for the price of one on flights within Canada, the Supreme Court of Canada ruled on Thursday.

The high court declined to hear an appeal by Canadian airlines of a decision by the Canadian Transportation Agency that people who are "functionally disabled by obesity" deserve to have two seats for one fare.

The airlines had lost an appeal at the Federal Court of Appeal in May and had sought to launch a fresh appeal at the Supreme Court. The court's decision not to hear a new appeal means the one-person-one-fare policy stands.

The appeal had been launched by Air Canada, Air Canada Jazz and WestJet.

This wouldn't be as much of an issue if airlines would stop packing people in like sardines. Yes, I know airfares would increase. But some of the seats are so narrow that even skinny people are uncomfortable in them. First class seats for everyone!

Lady, people aren't chocolates. Do you know what they are mostly? Bastards. ####### coated bastards with ####### filling. But I don't find them half as annoying as I find naive bobble-headed optimists who walk around vomiting sunshine.

Yeah that is true - whenever I fly its always a battle to secure a portion of the armrests. Then if the person in front puts their seat back - pretty much anyone over 5' 7" gets the seat back pressing on your knees.

Yeah that is true - whenever I fly its always a battle to secure a portion of the armrests. Then if the person in front puts their seat back - pretty much anyone over 5' 7" gets the seat back pressing on your knees.

I nearly passed out from having my leg's circulation cut off on one transatlantic flight. Noticed when I got up to stretch.

So I wonder... if this passage sticks... what BMI will they use to judge for 2-seat vs 1-seat obesity.

Will there be nurses on call at airports to verify this?

And I'm 6'1" with a BMI in the normal range.

we have traveled over seas most of my life im only 4ft 8 and half inch tall not obese and find the seats hard to deal with if i want to read when the person in front of me puts their seat back unless i do it to their head is almost in my lap if they dont put their seats up when i want to get out for bathroom or just walking around on the over seas flights its like going thru a obstetrical course........i think the international flights at least should be more comfortable

Well the airlines are already immune to prosecution if someone gets a deep vein thrombosis on a long haul flight.

I'm less inclined to be sympathetic to obese people in respect of needing 2 seats. Certainly I don't think the 2nd seat should be free.

on my last flight back from the states an extremely fat woman in a moo moo spent her whole time with her knee in my back on purpose because she was mad that i had my seat reclined. when i complained to the attendant about her behaviour (and her children) she got so mad and went totally crazy, claiming she could not fit in the seat, basically admitting she was obese. i should pay for one seat and be uncomfortable but she should get an extra free seat? wow... that's justice for you. :bonk:

how about she stops eating cheeseburgers? :whistle:

This just means that flight costs will increase as the Canadian carriers are losing revenue by having to give two seats for the price of one. Personally, I don't think I should have to pay more for a flight just because certain obese people refuse to eat less. How will an airline determine obesity? Will there be a fat measuring gadget at check-in? I think you are extremely selfish if your lack of willpower puts others at a financial disadvantage.
