Hi all, my US husband is currently out of work but looking. Will putting unemployed on the I-130/I-129 forms affect the outcome of the descision at this stage or is it only important when he submits the affidavit of support document?

He is sure he will find work before we get to that stage, but worried at the minute in case it will affect the approval of the I-130.

on the I130 they ask for the past 3 years proof so not sure because it usually is best to also show current pay stubs and letter from the work. I think to explain well the situation and hopefully he will find something new by the time the money papers are due, if not maybe a co sponsor will help to get thru this time of looking

This is similar to my situation. I wasn't employed when I submitted the I-130 and I Put Unemployed on the form. When the time came, I submitted my employment letter and pay stubs and was approved. So, It will not matter at this stage, they process the affidavit of support based on the documents he will provide when the time comes: Pay stubs, assets, cosponsor, etc. Good luck

  • I-130 SENT 2-19
  • NOA1 RECEIVED 3-03
  • I-129F SENT 3-14
  • NOA1 RECEIVED 3-21
  • NOA2 RECEIVED 10-11
  • NVC CASE COMPLETE 11-21

Thanks for your replies. Maybe a little background will help. Me and my husband have lived in the UK the past 3 and a half years and have decided to make the move to the USA. While over here, he did not work, I was the main wage earner. Now we have decided to go Stateside, he has gone back early to find work, accomodation etc, so he has no work history for the past 4 years or so, will this make things difficult for us?

Can he find someone that is willing to cosponsor?

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!
