OVERWHELMING I-134 co sponsor issue!

I am living in Minnesota and my co sponsor [father] is living in Texas. He has a job that requires him to be out of the states for a while.

He will be going to South America next month [end of December/beginning of January]. My fiance Luke and I will be applying for the K-1 visa and sending out the I-129F in the beginning of December some time.

I know that the I-134 form doesn't come into the whole process until later on when Luke has his interview. During that time my dad [co sponsor] will probably be away.

Can the co sponsor [dad] collect all the documents needed (notarized, dated and signed) and send them to me before he leaves?

Will those documents still be valid by the time we actually need them even though it wont have the last few months of bank statements and actual current balance as the documents have been collected early?

Will a letter from the co sponsor [dad] explaining why the documents are collected so early on in the process?

Any advice would really help. Without him we have no other option for the K-1.

Thank you as always,

Deanna and Luke

What does that mean? How will it effect us?

It means your father will need to include his 2008 tax return (complete) or transcript as supporting documentation to the I-134. He can have the I-134 notarized at a US Embassy or Consulate abroad. It's too early now.

I'm from Big Lake. Have you started the visa?

So all the documents wouldn't be valid if I receive them a a few months before filing the I-134?

The best practice is for the financial documents to be current as practical and dated after the petition is approved. There's no hard and fast rule on that for a K1 visa. They will accept what they decide to accept. You are asking for recommendations. There are few hard answers on this particular subject.

At most Consulates you will need to supply them with the most recent year's tax transcripts to prove income. If you collect everything now you will not have that.

Also, my guess is that the Consualte will want much more recent proof of income (employment letter/pay stubs...recently dated I-134) as the process is likely to take at least 6 months.

good luck
