temp EAD at JFK

Hi Guys,

I've posted this message in the AOS forum but now I think I should have maybe posted it here!

my question is that I want to get a temp EAD when I arrive in the states on my K1 visa, and I know that JFK is the only place that issues these.

Will I go through all the POE and immigration stuff using connecting flights?, as I clearly remember last year when I flew to SF via Atlanta that all of the POE stuff happened at SF.

maybe I should just purchase two seperate flights with different airlines?

any help is really appreciated

The EAD you can get at POE (JFK is the main place) is only valid for 90 days from entry.... as you need to apply and recieve your SSN before you can start work and that can take a few weeks to get... you will only be able to work for a short time... You will need to file for your 1 year EAD along with your AOS and it can take 90 days+ to get... so when your Temp EAD expires you will have to give up work and wait for your 1 year EAD...

Most people agree that it is a waist of time getting the Temp EAD, starting a job only to have to give it up 8 weeks later... even if you got married the day you arrived in the states and had all your paperwork ready to go and got your Certified Marriage Certificate the same day and mailed it on your wedding day the chances of having your EAD approved before the Temp one runs out is 0....

Hope this help with your planning, may be better just to plan on having a few months off work and wait for the 1 year EAD...

you will receive ur ead stamp at the POE upon ur entrance to US. So if JFK is the first airport that u enter into the US well that is where your "mysterious" brown envelope will be processed and u can receive ur stamp there. Like u said, it just depends on what POE u enter thru. Also just purchase ur flight ticket whereas JFK is ur POE if possible. My hubby entered thru JFK and received his stamp. He did work using the stamp and his employer continued to let him work even after the 90 day expiration. Check out our timeline. Hopes this help!

I arranged my flights so that I ended up with my POE as JFK but it wasn't easy.

I called airports to find out if they had an american customs office there and was able to only find one airport in all of Canada and that was in Halifax. So, I booked tickets on 2 different airlines - one from Ottawa to Halifax, and another from Halifax to JFK so that I was able to get the EAD stamp on my passport.

You Husbands employer was breaking the law by allowing him to continue to work when he was not authorised to do so... This can also cause problems with USCIS when you are asked at interview if you have done any work before you recieved your 1 year EAD..... not something I would recommend to anyone....

I understand that unauthorized work by spouses of USCs is forgiven. It is the employer who would be in trouble for that.

Yes it can and usually is forgiven at intervew but it can also be used against you if they wish too... why give them any reason to turn you down all for the sake of a few weeks work...

It is much better to do thing the right way and know you have given USCIS no reasons for a denial....
