Hi guys,

I'm a newbie to this forum, I've spent the last few months in the waiver i-601 forum and finally our application was approved!!.... and so now to flying over to the states to be with my sweetheart.

My final destination with be San Francisco airport, but I am considering flying to SF via JFK, as I would really like to get a temp work permit, and I hear this is the only airport where you can get one?!

and so my question is, would I actually go through the POE and all the immigration stuff (including asking for the temp EAD) at JFK if my final destination was San Fran, or would all of this happen at SF??

any info from people who have been in this situation would be most helpful

but now that I remember, when I flew to SF last year it was via Atlanta, and I clearly remember going through all the POE stuff at San Francisco!!!

that was using CONNECTING flights.......

I guess if I flew with different airlines (eg. Air France to JFK and then AA to SF) then I would go through all the POE in JFK.........

what do you guys think?

I'm not positive about this, but I think you normally go through immigration at the first airport in the U.S. where you arrive. This policy might have changed since the last time you visited the U.S.

In my husband's case he had a flight directly from Asia to JFK and was hoping to get his temp EAD stamp in the JFK airport. He knew there was a refueling stop in Anchorage, AK but didn't think that would make a difference. Well it turned out that they all went through immigration at Anchorage and he was not granted that EAD stamp after all! Then all the passengers got back on the plane and proceeded on to JFK as if it were a domestic flight.

08/29/09: Applied for U.S. Passport (routine service)

The EAD you can get at POE (JFK is the main place) is only valid for 90 days from entry.... as you need to apply and recieve your SSN before you can start work and that can take a few weeks to get... you will only be able to work for a short time... You will need to file for your 1 year EAD along with your AOS and it can take 90 days+ to get... so when your Temp EAD expires you will have to give up work and wait for your 1 year EAD...

Most people agree that it is a waist of time getting the Temp EAD, starting a job only to have to give it up 8 weeks later... even if you got married the day you arrived in the states and had all your paperwork ready to go and got your Certified Marriage Certificate the same day and mailed it on your wedding day the chances of having your EAD approved before the Temp one runs out is 0....

Hope this help with your planning, may be better just to plan on having a few months off work and wait for the 1 year EAD...

but now that I remember, when I flew to SF last year it was via Atlanta, and I clearly remember going through all the POE stuff at San Francisco!!!

that was using CONNECTING flights.......

I guess if I flew with different airlines (eg. Air France to JFK and then AA to SF) then I would go through all the POE in JFK.........

what do you guys think?

The First POE is always the place you go through immigration :thumbs:

The only difference this time is, you will hand over your envelope(unopened) and get processed, also fill out the white I-94 not the green one, (on the plane) :yes:

My husband arrived in JFK with a K-3, and he didn't get a temporary EAD. Is this temporary EAD only available to K-1? I find sort of weird that they give one to K-1's but not to K-3's. Does it make sense. :huh: .

YES its only available to K1 :thumbs:

I think you're right!! :P my fiancee assures me that on that occasion I did go through customs in Atlanta! oh well, it must have been a long day!

thanks for all of the info guys, I just wanted to be sure about that. I'm gonna still ask for the temp EAD even if it's only gonna be for 8 weeks or so, it still $$$$$$ isn't it???
