Hi everybody,

I was wondering if anybody can help me out with this.

If my K3 application gets approved before my CR1 visa interview date is granted what do i do?

Can i still go for the CR1 interview as and when due and not break any rules.

what i am asking in essence is will getting a k3 visa mean that i must now file for an adjustment of status and all that other stuff and thus forfeit my CR1 application process that is still in the works?

The answer to this question will be really helpful to me and mine

You may obtain both visas. If you actually use the K3 visa though, I expect you'll find it impractical to return to Nigeria to interview for the CR1. Instead, you would probably find it more practical to adjust status.

I am interrested to understand this situation too. From reading few posts from other people experiences who went thru Casablanca, it seems if a person is granted K3 visa and decide to go for the CR1 interview, the k3 visa will be cancelled the day of the CR1 interview. I am not sure if this applies to Casablanca only. If anyone has different opinion, please advise. Thanks

That's not Embassy or Consulate specific.

A CR1 interview is visa and status all rolled together. If you are approved for the CR1 or IR1 visa, the K3 is void because you've already been granted Legal Permanent Resident status, effective upon US entry. It would have no purpose anyway. If your CR1 or IR1 is denied, it's like jumping forward to the AOS interview, which is also denied. The K3 would no longer have a purpose because there's nothing to "wait" for.

What is very likely is that the applicant would go through an indefinite period of Administrative Processing.

I always advise somebody with a K3 visa to get themselves to the USA and deal with the rest while united with their spouse.

I agree with Pushbrk. If you get the K3 he should immigrate at that point and not wait for the CR1 or IR1. I think this is a good approach because Nigeria is considered a high fraud country. I have seen some VJ members put on Administrative Processing during the visa process AND again during the AOS phase. AP is indefinite....and there's little you can do but wait. Yes, CR1/IR1 has the advantage of being work authorized, but unless your hubby has lived in the US before, he will most likely benefit from some down time to adjust.
