Hello all,

My husband and I are fairly confused with this whole AOS process. We were married in June 2008 and we are in the process of filing for my AOS. I have an existing EAD with my current visa status which expires in April. We are hoping that I could get a new EAD with my AOS before my current EAD expires -- which should be possible theoretically -- so that I can keep my current job. Now my question is, how long can I work on the EAD before I get my permanent residency? It seems like it could take years to actually get my permanent residency. Do you keep having to renew my EAD until my permanent residency is established?

Also, is the EAD on AOS conditional on 485? We are missing his most recent tax form for 864 (just moved to this place) but have everything else ready to go. We are contacting IRS to get his 2007 tax form but it could take more than two weeks. Is it okay if we send in our application now or should we wait until we get his tax form to send everything together? I realize that our time frame is very tight (should have started working on it a while ago) and want to make sure that I don't use my current job in this job market!

An RFE on the I-485 will cause a delay on any applied for interim benefits associated with the I-485.

You can work on EAD as long as it is valid... If it is needed to be renewed, you submit documents to renew. Once you have residency then EAD or EAD renewal is no longer needed.
