I got the DS-230 forms today!

Timeline

Hi all, I have a couple (actually, a few) quick (I hope) questions about the DS-230 part I.

1. There is no part II? Will that be filled out at the embassy?

2. At the end of the form there is a field for the applicant signature. He is the applicant but I am the one with the form as his designated agent. Can I sign that, or do I need to forward it to him to sign and return?

3. He has never been married but I am a divorcee... does he need to bring a copy of my divorce decree to the consulate?

DS-230 part II will be in packet 4 received from the consulate.

DS-230 is the Application for a Visa and Alien Registration....as such the beneficiary, now the applicant, signs that form. The DS-230 can be downloaded, filled in and signed by the applicant (beneficiary) and posted back to the USC petitioner. You can download it HERE

Some send it along but some dont. I am taking a copy of my husbands to the interview in the morning but I I am not expecting to be asked for it.

HI Dina,

;) Your journey is almost over!

now here are the answers

1. Yes, you need to send only part-1, to NVC. and the part 2 will be filled out for embassy.

2. Your spouse need to sign on the end of forms, definitly if you sign them , that should match and yr spouse must know and agree that you did it.

3. Your divorce decree ATTESTED must be attached with ds-230 and, and a biographic page of Passport.

and original Divorce decree will be required at consulate.

I was thinking about this some more and what I am having trouble with is: why would they bother with the whole appointing an agent business if the beneficiary needs to sign the form anyway. It just doesn't make any sense to me. :wacko:

Of course, this is our government, I shouldn't expect anything resembling logic... :whistle:

Hmmm, I don't see an option to edit my post. :( Well, I did manage to get my answer. He DOES in fact need to sign it (Aussie was right, naturally!) the reason why they do the agent thing is that there are other forms that would be sent to him that I needed to fill out if he didn't. Well, all this means is another trip to the post office at lunch today. I should have my own reserved parking spot over there by now. B)

ANSWERS:

1. Your spouse will take the DS 230 part II to the Embassy during the interview. Your husband also needs to take the DS 230 part I to the Embassy during his interview, but have him check the interview appointment letter that was mailed to him by the Embassy. He only needs to sign and date DS-230 Part I. He will need to sign part II in front of the consular officer during the interview. Make sure, both part I and II are filled out prior to the interview.

2. DS 230 part I is the biographic information of the applicant (beneficiary). Therefore, your husband needs to sign and date it. You definitely don't sign the DS 230 I or II.

3. When you filed the I-130 in USA, you must have send your divorce decree along with it. Most likely, USCIS and subsequently NVC send everything that you sent along with your divorce decree to the Embassy. But it does not hurt to send him a copy of your divorce decree. The consular officer might ask him during the interview whether he has your divorce decree or not, in order to find out whether you shared your past divorce with him or not.

I should add one thing with this:

You will need to mail DS 320 part I to NVC. Also most likely, your husband will need to take another DS 230 part I to the embassy during his interview. He will also need to take part II during the interview. So prepare both parts before the interview. He should sign and date part I and the consular officer will ask him to sign part II during the interview. You can download both parts from the link that Aussiewench had provided and start preparing them.

I also sent him our marriage certificae, my divorce decree and my birth certificate (which looks, incidentally, like it's survived fire and 3000 years in a tomb) just in case the consulate wants any other truely useless information. :D

You are right on track! Yes, the US Embassy/Consulate will mail him DS 230 I and DS 230 II along with the interview appointment letter.

They don't have the visa applicant assign an agent, they offer the option to assign an agent should the visa applicant prefer to have an agent. There could be any number of reasons why one might prefer to have the correspondance go through an agent rather than directly to the visa applicant.

Shameless bump: Does anyone know why they would have him assign an agent when he needs to sign the documents anyway? I am still trying to call the NVC. :)
