Help me please..........!!

Hi all,

I am new here, but I would like to ask few questions about my case. I am permanent resident, I married and my wife who still lives in Vietnam. I filed I130 to Nebraska in 8/2004, I had 797C but not 797. I recently recieved a letter said that they moved my case to CA, my questions are:

1. I still have not had 797 approval, why? do I need a lawyer?

2. When I become a US citizen (I will call to update for US citizen), should I use K3 visa? or stay as US visa for spouse (which ones id faster?)

If anyone knows or had experiences, please help me to determine which visa to get her fastest, thanks alot.

08/24/2004 - Filed I130 (i am green card holder :) )

02/14/2007 - I130 Aprroved

05/31/2007 - Update to US citizen (IR1)

07/2/2007 - I864 fee bill sent

07/23/2007 - I864 form sent

07/30/2007 - IV fee sent

08/21/2007 - They said they sent DS230 to me, but not yet received

09/15/2007 - Got DS230 and sent back to NVC

10/03/2007 - Case is done at NVC.

12/14/2007 - Interview at HCM embassy.

01/23/2008 - Back to State together( hopefuly :) )

8-12-2004 I moved to New Zealand(married my Kiwi in US 5/04)

1-12-2006 Received initial packet - It has I-130, I-864 & DS-230 Part 1, DS-2001 & tons of instructions.

Gathering paperwork that we don't have:

5-30-2006 - I-130 FILED AND ACCEPTED BY AUCKLAND CONSULATE!- INTERVIEW: 6/13/2006

Hi...

I would check out the USCIS webiste to see what the dates are for spouses of LPR's and see where you stand in that time frame. Seeing that you're an LPR, unfortuately, your status will not be upgraded to priority until you become a USC.

Now, if you file for K3, she will have to obtain EAD and AP, and adjust later. Although it may be better for you in the end simply to get here here, and work out the rest later.

If you stay with the CR1, she willl not have to adjust, and she will not need EAD or AP. All of that will be taken care of with her green card.

From what I have seen, it takes a bit longer, but the benefits are that you will be done with the process until you have to life conditions in 2 years.

See what works out better for you both...

Unless you have a problem, don't bother with a lawyer. Not worth it !

Thanks all for infomation. I checked the processing time, and it is Jan of 2005. It means should be active now, does'n it? But I still don't have the 797 yet. I called about 5-6 times in the last 3 months but then what i got is waitting for 1 or 2 more months (people at INS said so). The last call they told me "after they transfer to CA, you should have the decision in 2 months". Two months is almost over, I guess I will call again but it makes me frustrated because I call many times and it seems to me that they don't do anything. Anyway, thanks again and I will call them again then.

If anyone has other information, please do so and I really appreciate it.
