Daughter-in-law was refused entry to US at port of entry. She was assigned an alien number. She was not given any paperwork. We are assuming she withdrew her request for admission and will not require a waiver. Case is at NVC and they are requesting court docs as on Part II of the 230 she answered "yes" when they asked if you have ever been denied entry at port. Submitted a full explanation and NVC says now need a detailed letter. Anyway had similar circumstances?

I'm confused. Why would you need a waiver because of your daughter-in-law's admission problems? Your daughter-in-law's immigration history will have no bearing whatsoever on you.

I am asking on behalf of my daughter-in-law. She is the one requesting the CR1 visa and her paperwork is at NVC and they are requesting a clarification as to her admission and visa issuance.

It's really difficult to tell from the information given.

If she is certain that they allowed her to withdraw her application, and the officers said it just that way, and she signed papers that said that specifically, then she will not need a waiver.

I am only a little doubtful because of the A# being assigned. . .if her A# was assigned at the POE, that might be a problem. . .if you're just talking about the A# assigned by USCIS then no problem.

In the letter to NVC she needs to note that she has never been in deportation proceedings, so there are no court documents. . . and that she was only denied at the POE, and if she is certain that she withdrew her application, she needs to note that as well.
