Ugh. Let me rephrase, now that I read your other version of the story meauxna linked to. You're worried about being charged with immigration fraud. You knew his work visa had expired when you applied for his visa.

Also, a smart person on the other site reminded you that if he somehow stays, your Affidavit of Support (I-184) goes on whether your marriage does or not.

Hopefully, you can withdraw your petition for his visa by simply saying the marriage failed. This may, at the same time, void your Affidavit of Support. Get advice immediately from USCIS or a good immigration lawyer. Don't wait for the interview and try to "tell the truth" with a teary rationale about how you were young, naive, and needed money.

Would he implicate you? Right now, no, because you're his only ticket to the USA. But after he's been denied a visa, he might. By that time, he'd be on a deportation order and they may not waste time coming after you. If they do, that would be the time to play the young-and-foolish card because there is some truth in it.
