Hello VJers,

We are now in the AOS process. Today we applied for my husbands ssn and then we went to the DMV to try and get his Colorado driver's license. When he got to the DMV they said he needed some form from USCIS. Has anyone had any experience with this? What did you do? What documents do you need? THANKS!!!

June 9th 2012 - Application sent

June 14th 2012 - NOA sent

June 28th - Biometrics letter sent -- July 26th Appointment date

July 12th 2012 - Early Biometrics/Walk-in

August ( ) - Interview letter received -- September 14th Interview date

September 14th 2012 - Interview! Oath date in hand, September 20th @ noon!

Soon you will receive the NOA1, receipt for your AOS application. Showing the original of this receipt is sufficient in many states to satisfy DMV requirements.

Do you have any idea what form they asked for? I'm trying to figure this out before we head to the CO DMV in about a month.

It appears from their list of required documents that they will allow a visaholder with valid I94 to obtain a DL, but it is possible that they (like Texas and Louisiana) will not honor the I94 for the K1 visa.

At a minimum, for a K1, since the I94 expires is such a short time, it appears that the next proof of lawful presence is an EAD card. When did you file AOS? The EAD card should arrive about 60-75 days after you filed and you can use that as proof of lawful presence in the US and the foreign passport as proof of identity.

in texas u cant make a dl until u have the greencard..on the phone they told me i need the NOA1 and as i arrived to make the test they told me no...i was really pissed...they said u can come again when u have the gc..i asked also if it will work with the EAD...no only greencard..grrrrrrrrrrrrrr

I see where they have 90 day residency requirement. We were hoping not to have to wait for the EAD since she has a SSN from a previous J-1 visa. Her case is a bit different from the OPs, as her visa is a K-3.

What does anyone know about driving with a foreign license or an international driver's license in CO? We were hoping she could enroll in driver's ed immediately for several reasons. She drives, but doesn't like too. I don't blame her, as the roads are a pretty scary place to be in Thailand, and the rules are very different. Where we live you can't go anyplace unless you drive or someone can give you a ride.

Here in CA, I just presented my SSN (married name) and K1 visa at the DMV office. I already passed both written and behind the wheel exams, they gave me a temporary DL. I am now waiting for the DL ID card in the mail.

From what I saw on the colorado website, a passport and I94 with 6 months (180 days) and valid visa is all that is required for a license. My wife studied the manual and we got her a learners permit, then enrolled her in driving school for a few weeks before she was ready to take the driving test. After she completed the school she got her license. She was a K3 visaholder and did not have her EAD card before she got her license. (This is in Texas and whoever that person was who said Texas required an EAD card before issuing license is a moron posting bad information on this site) Texas requires a visa, proof that you are not eligible for a SS card, and an I94 that still allows a minimum of (1) year of legal status.

Thanks for sharing that info. It is very helpful. It's sometimes hard to unearth the info that applies to those on a K-3 visa.

Yes, I had this experienced but they were looking for my I-485 or unexpired I-94.

I'm from B.C. all I needed to get my license in Florida was my Canadian License. This is also before I even got married or applied for AOS. The license they gave me says "temporary" and is valid for 1 year, but there was nothing to it!

I also didn't surrender my Canadian license, so my FL license is only valid in FL, but that's ok with me.

I think we are just going to make she gets her international driving permit before she comes. That way if CO won't issue her a license, at least she won't be stuck here all the time unless someone else can drive her. There is no public transport here. With some orientation she'll do very well.
