Visiting foreign fiance during the K-1 process

Hello,

I have searched the forum and read over the FAQs and didn't find this answer.

I was wondering if I the U.S citizen is allowed to visit my fiance during the K-1 process.

If so, when is the best time? How long can I stay?

I am currently 18 and am a student. My dad will be the co-sponsor as he makes well above the 125% poverty level.

Since I am a student do I need a job? Will it look bad if I do not. I will have a job before we fill in the I-134. I just don't know if I will when we file the I-129F.

Like any person on this forum I would love to spend as much time with him and his wonderful family as I can.

We could use all the advice and personal experience we can get.

Thank You,

Deanna

Of course you (the USC) is allowed to visit your foreign fiance's country - stay as long as you're 'normally' allowed to.

If it were me, one thing I'd make sure of is for someone (family/friend) could collect my mail and let me know if I get any notices from USCIS while I'm out of the country.

Thanks for your response.

Is it worth mentioning to the UK immigration that you are in the K1 process?

Thanks again.

If you say you're coming to visit your fiance, it might put them at ease to say he's immigrating to the US but it really doesn't matter. You're just visiting the UK. No worries.

Thanks for the info.

BMI have stopped there service between Manchester, UK to Chicago which sucks. Not many airlines do that now, most fly from London.

Now would it matter that I do not have a job in the first part during the I-129F from? I'm 18, a student, and I have a co sponsor that is well qualified for it.

Our thinking was for me to stay a good month at least in the UK with my fiance during the first part of the K-1 process. With a job I will not be able to do so.

Would it look bad if on the I-129F form I don't have a job and on the I-134 form I do?

Any suggestions, advice or similar experiences?

Thank You,

Deanna and Luke

Your job is being a student! As for the I-134, you will need to get advice from others who've gone through the UK, as to whether or not they accept co-sponsers. For the I-864, you'll have no problem.

As to the original question of visiting... the more time you spend together, the more evidence you have of a bonafide relationship. Take plenty of pictures and keep all your boarding passes as proof of an ongoing relationship, along with the stamps in your passport.

Thank you for taking the time to respond. We know that co sponsors are excepted on the I-134. Luke and I have 5 trips total from visiting each other. Adding up the time spent in each other's countries with each other 11 almost 12 months. We have every ticket there and back from all those trips and have over a 1,000 pictures together since we have met.

I am just very worried about being young and being a student and not having a job. I just don't know if it will look bad with me not working in the beginning and just having a co sponsor.

Sorry if my words are confusing you ha.

Anyway, thank you for your advice.

Yes you can visit, that will even better to do so. As far as the time frame, each country is different, if you stay longer that allowable time frame that there will be a penalty. As far as financial, right now it wont matter in I-129F but will be a factor later. Goodluck!

Deanna, it's the job of the CO to ensure that Luke will not become a financial burden to the US, not to judge you for your age or being a student. You are certainly not the first unemployed student to get married!

It is your job to prove you have an ongoing relationship, which will not be a problem, and that Luke will not become a finacial burden, which he will not since you have a co-sponser.

Your age and occupation are not key to this process.

Ohh thank you so much for all your advice and reassurance. It really does help.

@roi_aggie

Thank you for explaining it that way. Very clear and appreciate it a great deal. It's all such a worry sometimes but great to get others opinions.

@Dave and Jess

I have flown Virgin before and find them a great airline to fly with very competitive prices. I think it may have to be London as I can't see an easy way around it. Thanks though for your input.

So currently we are just spending our time filling out the G-325A and making sure it all syncs up and dates are all correct. I-129F is almost ready too. Just picked out about 30 photo's from when we first met to most recently. A good amount? Deanna has most of the evidence but I still need to send some stuff over. Getting our pics done next week and should all be coming together nicely then.

Hope everyone is well.

Luke and Deanna.
