I have read the stickys and trying to make a determination as to where this is. I am writing this as I understand it.

Mom is married to us resident and they filed for the kids got all that approved. older child had a 1-130 filed and received the I-797C approved. since she is terrified about requesting information she has let this process stop and the last action that was done for her by INS almost 13 yrs ago. She is still without papers, no work authorization, nothing because she has not known what to do now.

I am reading the copy of the 1-797 showing 1-130 approved under, unmarried child (age 21 or older) of us citizen. It shows an Alien number also. So what does she need to do now? it says something about apply for adjustment of status ($1010.00 fee. Does she need to pay this also? she keeps insisting that the parents paid for this back when the i-130 was submit? Is this correct? Sorry if this is posted to the wrong forum, but i dont understand the k1, and all the other words and letters. please help me so that i can steer her in the right direction. She has been working odd jobs and never really settled down because of no SS and no papers.

She has an approved I 130, the next step would usually be to attend the Consulate interview.

Is she in the US, what status does she have?

I have a feeling this one may be for a Lawyer, sounds like a 245i, of which I know little.

Boiler thank you. Yes she is still in the US. But she is terrified about asking immigration for any information for fear of deportation. I contacted service center and they said to fill out 4 - 5 forms send in $1000.00+. But she insists that these amounts were paid for already. Her mom married a us citizen and they had told her at that time that she needed to wait because she was over 18 at the time. But she is staying with me and cant work, is afraid to go to town and simply lives a sheltered life.

I downloaded the adjustment of status and it says to send it in with the fee. But because the fee is alot, i dont want to send it in without knowing if this is the correct thing to do at this point. I appreciate your help and response as she is also reading along with me. thank you for any help.

This is going back but the I-130 is just the start, if her Parents paid for something they will have had receipts, I doubt it.

So she entered the US how? I take it that she is long out of status.

Anyway UNLESS she qualifies for the last Amnesty she would have to go to her home country Consulate, she would have a 10 year ban to serve before she could re-enter.

So effectively the number one question is does she still qualifies for the Amnesty.

Try www.immigrate2us.net, more likely to know. Make sure you have the full story, details can matter.
