well, I saw the congressman's immigration director today and he found that my applications are still being looked at. Basically, what I already knew as of November 6. This was the first time I met him, so I guess it helped a bit. He said there is nothing they can do once the applications are in the adjudication phase. The USCIS has up to 80 business days to adjudicate the applications. If they go beyond that, the congressman can get involved again.

He did ask me follow up again on Monday. The agony continues...

Here's an update: My both applications were touched on 11/21/2008 and pending.

desiman, i see your approval coming before the end of the month. lets see if my prophesy works! maybe the adjudicator who had your file a few days ago went on a vacation to bahamas with his wife who had also gotten a K3 a few years ago and maybe one night while they were making love she made him promise that he would go back to work and approve as many K3 and CR-1/IR-1 visas as he can and he came back in the happiest mood ever....i mean who knows...stay positive dude...you are just around the corner with cjvasani and a few others...good luck!

I like that scenario! Let's see what happens in next couple of weeks.

I say you (desiman) and I both are approved next week.

I think so too. The dates, at least for I-130, are pretty close.

Of course, lack of knowledge on I-129F was the main reason for a late filing, but as long as I-130 gets approved, I'm good because that's all I want anyway. The other one is more like a "side kick!" ;)

I don't know about next week...VSC is huffing and puffing with a few approvals this week...

But I have strong feelings that you two will be approved before the end of the year...all March filers for that matter. They will probably begin April filers in the new year.

Oh, but I'm superstitious now....so I hope you guys DON'T get approved soon... ;)

it sucks...I say f them. It comes when it comes...we can't change ourselves cuz of these f'ing bastards who can't figure out where they should be putting US Citizen's family as a priority. I am going to ask Anu to start working again, so she can stop driving herself nuts and become stronger so that she can face the questions from 'society' doubting our marriage, doubting my 'legal' status in US, etc. I need to concentrate on buying a house and I'll do just that...enough of this anxiety.

Brother I'm with ya. I got nothing. Congressman's office contacted VSC on Monday, and the liaison at VSC has not responded to the aide's inquiry on my behalf. On top of that, I called USCIS today, and asked them if there was anything showing in the system regarding my status inquiry they took on 10/27, and the rep (who was actually a pretty nice one and seemed to take reasonable effort to check up on things), told me that my inquiry is not showing in the system - she said that VSC, at their discretion, can choose to "not respond" to a status request if the processing times move backward during during the 45 day period that are required to respond to the request.

Ain't that convenient.

Are they really working to get approvals done or holding work back for job security? They must be fearing who's going to bailout the government!

correct me if i am worng guys, i dont think we have a lot of feb filers left now. or do we? i think we are well in march with full swing...hang in there guys, just a little more. your wait times are almost over...God bless!

Yes, not many Feb filers left and we are already seeing March filers getting consistently approved, so 'theoretically' we are due any day...unless of course, VSC decides to be 'dead' all over again. let's see if they can wake up from the Thanksgiving hangover.

Unfortumately I am a Feb/March(thanks for the lag lawyer) filer - got through VSC pretty quickly my hang-up is at the embassy........

3/20/08 NOA1

6/20/08 NOA2

7/05/08 Packet 3

12/22/08 Interview

12/29/08 Visa Delivered

1/26/08 POE

3/20/08 Wedding

I received an email requesting evidence for I-129F. I called to find out what it is, a very nice rep, Erica, said she can't tell what it is since their system doesn't show that. So I have to wait for the letter.

Regarding I-130, she said her system shows that they have completed processing I-130 upto 2/27/2008, I am only 3 days out from their timeline, therefore I qualify for a service request. So I put in the request and I am given a confirmation number and was told that it should be assigned to an adjudicator before Christmas. If I don't hear anything on my case by then, I should call back.

Yeah, it is! I am sure it has to be minor because I've made sure when I sent in. In anycase, we'll see what it is when it gets in the mail.

Hey DesiMan! If they linked your I-129F and I-130 then the RFE is might be for both petitions as they generally required the same documentation. Once the documentation for the RFE is received back at VSC then it usually takes about 2 weeks to review and hopefully approve but can take a month. I would assume that an approval would come after you the satisfy the RFE. Congrats on the progress. I'm pulling for everyone.

I would look at any type of corresponce started USCIS to be a good thing.

I have a feeling u r da first one among us to get an approval shortly...................keep ur finger crossed and also for us...poor weeee.....

Hey DesiMan! If they linked your I-129F and I-130 then the RFE is might be for both petitions as they generally required the same documentation. I am glad to see a guiding response regarding RFE. I hope it works just like you said as I already anticipate it to be either Min-December or Christmas/New Year. You're right, at least they have my paper work.

Let's see what they want through an RFE. I am sure good days are to come since they must be in a good holiday season mood and trying to meet their goals for the year... hopefully they can at least get to all march, possible into April before year-end. Good luck!
