i have a it of a problem

on october 31 2007 i filed a petition to remove the conditional basis of my permanent status

since then i did the biometrics and everything

on november 19 2008 i receive a letter stating that my i-751 has been denied due to failure to appear for the interview concerning the marriage fraud amendment.

only i didn't receive that letter

therefor by november 12 2008 all my privileges are terminated

have two options

file a i-290b to re-open the case knowing that its hard to prove that i didn't received the notice

or

re-file for i-751 all over again

what should i do beside seeking a lawyer

i also have two jobs right now so is it illegal for me to even show up?

any help is appreciated as i am hopless

DId you move from october 21, 2007 to nov 2008? If you did and you didn't tell to USCIS then you will be at fault to that. But if you did told them and you didn't receive any letter for interview then its not your fault. Contact a lawyer though. Good luck and God bless to you

DId you move from october 21, 2007 to nov 2008? If you did and you didn't tell to USCIS then you will be at fault to that. But if you did told them and you didn't receive any letter for interview then its not your fault. Contact a lawyer though. Good luck and God bless to you

yes i moved and did notify them over the phone and via a-11 form through the mail(still got the receipt)

i called the 800 number today and they tell me that my case is still pending

the representative advise me to schedule an appointment at the hialeah field office to see what happened

can they do that?

Make an infopass appointment and bring in that notice showing that you filed your AR-11 and see if they can reopen the case. You may need to re-file the I-751 but probably not. Just go to that appointment and find out what happens. Just don't leave the country.

Where did you file? CSC or VSC?

With regards to you work - just continue showing up and/or go to work - Let your employer know that you are still in the process with your green card. It is your employer's call now if they still want to keep your job or not with regards to your legal status.

I think, it is best to get a lawyer if you can...

Where did you file? CSC or VSC?

With regards to you work - just continue showing up and/or go to work - Let your employer know that you are still in the process with your green card. It is your employer's call now if they still want to keep your job or not with regards to your legal status.

I think, it is best to get a lawyer if you can...

I wouldn't say anything to your employers about your immigration status unless you are asked. Then, I would answer honestly something to the effect of what Bulanglang said.

I would make an Infopass appt ASAP, and if possible, have your spouse accompany you to that appointment. Bring your proof that you submitted change of address information, and bring your copy of your I-751 stuff, including NOA-1 and biometrics letter. See if you can get the case re-opened.

i have an appointment monday dec 1st. thats the earliest

but a get mixed answers from the representatives

some say make an appt

others to write a letter to the field office

others say you can't go back so u have to file a i-290b and spend $580

i'll do it all anyway

sometimes you do all the right things, make sure everything is on point, gather all the infos, double check, follow up...

and it all fall apart because somebody else didn't do his part of the job wether its the officer or the post office

Yeah, that is the frightening part of all of this - when you play by all of the rules and dot all the 'i's and cross all the 't's - and through no fault of your own something like this happens. You are doing the right thing making the infopass appointment. They will be able to advise you of the next best step. Do seek a consultation with a lawyer as well. Why not prepare the I-290 just in case and if that is the necessary route, see if you can file it during the INFOPASS. If you don't need the form, then you can tear it up. Just remember, the mis-information line isn't called the Misinformation line for nothing. Any advice you received through a phone call is suspect unless you were forwarded to an actual immigration officer. The people who answer the phones and who attempt to answer the questions are not immigration staff - they work for a call center and are responsible for a lot of grief through their misinformation. Good luck with getting this mess straightened out quickly and inexpensively.

Make sure you interview via phone or in person more than one attorney, before you hire one. I interviewed 4 before deciding on the one I used. Get referrals from people who have used them. They can tell you who is good and who to run away from!
