Sorry folks...I usually do not go back to diapers...but I'm pretty sure this OP is actually someone previously booted (El_C). I really get sick of those who come on here and shout and spout mis information to those who truly have an intrest in helping people. Unfortunately, I took this guys bait.

Robert,

Sorry this took over your post. Best of luck to you and your significant other.

L&M

Yeah ... me too... You need to just not come on here period...

You are the one giving out wrong information...

They can not deny some who is eligible...

They have no authorization to question an approved petition by DHS they can only send it back for futher processing and if DHS still feel she is eligible they MUST issue the Visa..

Your regulations are older than the one Aussie showed you... That regulation over rules your older regulation from the year 2001 ... its called amendments.....

THE CONSULATE CAN NOT PERMENANTLY DENY A K VISA OR V VISA..... IF THEY COULD THEY WOULD HAVE THAT SAME DAY IF THEY FELT IT WAS A FRAUD RELATIONSHIP.... THEY CAN NOT MAKE THOSE TYPE OF DECISIONS AND PERMENANTLY DENY A K VISA OR V VISA.....

DUMMY

A REFUSAL IS ONLY STATING THEY ARE NOT WILLING TO PROCESS IT AT THE MOMENT ... IT NEEDS MORE INFORMATION TO BE PROCESSED..

A DENIAL IS STRAIGHT UP..... "YOU NOT APPROVED" YOU WONT GET A VISA NO QUESTIONS ASKED........

CONSULATED DO NOT DO PERMENANT DENIALS ON K VISAS OR V VISAS WITHOUT FIRST IT BEING SENT TO DHS AND GIVING THAT PERSON TO OVERCOME THE CONCERN OR GIVING THEM THE REQUIRED INFORMATION TO SUPPORT THE PETITION THATS HAS BEEN APPROVED..... AND LIKE I SAID....

IF DHS DOES NOT AGREE WITH THE CONSULATES FINDINGS....

THE MUST ISSUE THE VISA... BECAUSE SHE IS STILL AN "ELIGIBLE IMMIGRANT"......

Please stop the quotes. This thread is not readable.

The only person in America that can approve a visa is Jack Abramoff.

The petition is sent to Michael Chertoff at the DHS. When he determines that you are not a terrorist he sends it to Condoleza Rice at the embassy in the country of origin (DOS). If she has a problem she sends it back to Michael with an explanation as to what she found. If the visa is approved then again Michael gets to determine if the immigrant is moral enough to be an American. If it all passes the DHS and there is no problem then it goes to George Bush ( president ) and if Jack Abramoff has been paid properly then you get to stay here.

Hey Robertlaird, I am glad that you aren't letting this stupidity get to you. I am glad to see that all you got was the 221g for more evidence. Shon is right, a 212 is very different. That would be an actual denial! You will probably come out fine! Good luck and keep us up to date!
