Hi,

For James' AOS, I only have my most recent tax return available. Unfortunately my ex-husband has all my others and I have no way of getting hold of him.

How important is this? Will they want an explanation with the AOS package or shall we just send the one form in with the package?

19 Jan 2006 Received packet 4 (interview date). No connection with mailing on 17 Jan! Interview set for 9:30 on Tue 7th Feb.

07 Feb 2006 APPROVED!!!

01 Apr 2006 James due to fly to America

09 Apr 2006 Wedding date!!

I think the instructions may still say three years, but they recently changed the requirements.

All sponsors must submit the following documentation with their I-864:

Proof of current employment or self employment

A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

You may also, at your option, submit a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax returns for your second and third most recent tax years if you believe these additional tax returns may help you establish the ability to maintain your household income at the governing threshold set forth in Form I-864P, Poverty Guidelines.

It appears the I-864 form and the USCIS instructions are at odds with each other. We'll go with sending in just one return because both of you have advised this (with good reason) and we've only got the one anyway! B)

you can order free tax transcripts from the IRS at 800.829.1040. they are free, and I got mine in about 1 week. I used them for my I-864 when I files AOS without problems.

Most needs for tax return information can be met with a tax return transcript or a tax account transcript, rather than an actual copy of the return. The tax return transcript shows information from the return as it was originally filed. A tax account transcript shows any later adjustments either the taxpayer or the IRS made after the tax return was filed. Transcripts are provided free of charge. These transcripts may be acceptable substitutes for an actual copy of the return by the Bureau of Citizenship and Immigration Services and lending agencies for student loans and mortgages. Check with your agency or lender to be sure.

You can obtain a transcript by calling (800)–829–1040 or by completing and mailing Form 4506-T (PDF), Request for Transcript of Tax Return, to the address listed in the instructions to request all types of transcript verification of non-filing, and wage/income information.

Transcripts will be mailed directly to you, and should be received within two weeks after the IRS gets your request. Transcripts can be mailed to a third party if you specify this on Form 4506–T. However, you must sign and date the form giving your consent for the disclosure.
