i think it would be a good idea to do that, for uniformity. You would have to undergo that CFO seminar first though before you can use your married name, which isn't bad too. With your mentioning that your husband has yet to do his I-134 which, by the way, has to be notarized (have him photocopy that and have that photocopy notarized, too, and send it to you) I am surmising that you are applying for K3? Post your timeline; that would help us help you :)

First off....Is she using your name or her father's name? Did the father acknowlege paternity on her birth certificate? If so, you would be asked for a consent from him to let her go with you. Oh...and were the two of you married?

Now, if your case is like mine wherein the father's name does not appear on ANY of my daughter's documents, ther would not be a problem. I also executed an affidavit of illegitimacy and appended that to her visa application forms, just for more proof. Did not have any problem with that.

BTW, your daughter should be named on the I-129f that your hubby will file...or has he filed that already>?

You will have to get his consent then. A letter of consent. Notarized? Would be good, i would think, to make things official. As for the I-129F, her name should be included or she cannot get a K4 visa (deriviative child of the K3). He can file the I-129F after the I-130 is received by USCIS (the NOA1) and before the I-130 is approved.

CFO seminar is one given by PRISM to all fiances or spouses of foreign nationals. Is required before leaves. Immigration will not let you leave the country without it. Here in Manila, there are two places to have that seminar...at St. Mary's and at the PRISM office along Taft Ave in front of DLSU.
