Exactly 4 weeks today my I-130 was sent out - Money still not cashed

Hey guys,

This is my first post, although I have regularily read the boards. Hello to all of you!

Our situation is I drove her back to FL from Canada last April on what we had considered at the time was a few weeks of vacation. Well as we all know, it at times seems unbearable to leave your loved one only to go back to sitting in front of the webcam. Although not purposely, the inevitable happened - I relapsed into 'overstay' status (the USA-Canada VWP allows for a maximum of a 6 month vacation). We are in the process of AOS.

My wife and I have had a rough time trying to get everything done and filed so that I can finally get employment authorization to atleast bring in some money. We finally dropped off all our information on October 17th to our attorney to have her file it on October 20th.

It has now been 30 days and the money order still has not been cashed (I confirmed with the bank). After reviewing some of the timelines on this forum it seems apparent that the wait for the NOA1 should be anywhere from 3 days - 2 weeks from the date sent.

Should I be worrying? The longer this is put off, the longer I have to wait for further steps such as EAD. I have found myself getting very anxious/nervous lately when it has been normally Jennifer who is the worrier.

Did you submit the I-130 and I-485 concurrently?

Hi everybody, this is my first post too!

I sent all my forms on Oct 18, them were received on Oct 21. I received the NOA for i-130 on Nov 1st but I didn't receive one for i-485, instead I received the i-485 Notice of appointment for biometrics on Nov 7. I was pretty desperate waiting for i-485 NOA so i called the customer service number and they told me that I have to wait at least one month to be taken seriously.

You can try calling this number and see if there is any luck.

Dont panic, everything is going to be great.

I was freaking out a bit so my wife called USCIS to see if they had any information on us. They told her they had absolutely 0 information about us and no case was even pending.

About 2 hour ago she calls me and says that our attorney's phone number is out of service. What?? Are you kidding me? I dialed the number and low and behold it is disconnected.

1 Hour ago my wife calls back and says she made contact with our attorney. Whew!!!!!!!!

The news she gave me frustrates me. The attorney claimed she moved offices a few days after we dropped off everything to be filed (October 17th). She claims her secretary had my file and FORGOT to mail it out!!! She then gave my wife a tracking number and said that it was mailed out 2 days ago (coincedence since I called her yesterday? You decide.) I check the tracking number for USPS and it is only SCHEDULED to be picked up as of right now!!!!!!!!

So had I not called after being nervous waiting 4 weeks - Who knows how long it would of taken her to actually mail out our packet!!!!! I am sooooooooooooo angry at the lack of professionalism displayed on her behalf and cannot justify paying the amount we have paid her only for her to make such a novice mistake.

She knows we have been hurting financially (2 kids and us to feed, dress etc.) and how I have been waiting my best to get things rolling so I can work. To have this 1 month set back is devastating.

I feel ill right now.......

Sorry to hear about your troubles, if I was you I would really let the attorney have a piece of my mind - I'm sure you are paying a decent amount of money only to have his secretary not do her job.

My wife called and convinced me to take a deep breath and not do anything rational. After all I believe she still has my file in her hand until USPS picks it up. Getting her angry and with our luck (If we didnt have bad luck we would have none!) she would sabotage us =(

Wow!! That is so frustating! I am really sorry for you.

Now you just have to see the good side, you are starting the process!

I didnt use a lawyer because we couldn't affort it, so I did it myself making a lot of research here in the forums, and that sometimes scared me thinking about lose all that money if the forms were denied for some stupid mistake.

Now keep us informed about any new information about your case.
