i hired a immigration lawyer , she told me she will file for me next month because iam divorce now , and some people they said u have to file in 90 days window thats confusing me ? is everybody should file before 90 days or just the people who they are divorced ? thanks .

Once your divorce is final and you have your divorce papers you can file straight away, no need to wait for the 90 day window.

you can file your I-751 waiver anytime you have your decree with you. The 90 days window is for people filing their I-751 before the 2nd anniv of their CGC. We are the exceptions, where we can file before the 90 days if final decree is in your hand or we have to wait for the decree even if the 90 days window is over as long as one of the reasons for the delay is the lengthy process of your divorce. You should let the USCIS know of your case if divorce is still ongoing and can't file timely. See my timeline. Best of luck.
