Regarding AOS

Hello fellow VJ'ers!!

I am starting to prepare for AOS as early as now even if we wont be leaving till January.I have been browsing /reading thread for AOS trying to find answers.Me and my son will leave January for US and would like to file right away after marriage on AOS.My fiance works in Iraq and will only have maximum of 21 days of rnr every 4 months.We will try to squeeze everything in on the 21day rnr including civil marriage and intend to file before i 194 expires.Will my case raise any doubt on USCIS part if my fiance works overseas and only come home in the US on his rnr?Hope someone will shed a light on this one.Thank you

Raise any doubts about what? You can't help that your husband is deployed overseas. The only thing you are going to have to worry about is when or if you get an AOS interview, that he's home at that time to go to the interview with you. I don't know what you'll have to do in the case of him being overseas when that happens. Best to not worry about that.

Are you concerned because you won't be living in the same residence when you get over here? I'd not worry about that. Surely his working overseas, which is beyond his control, would be taken into account.

When I read your OP I thought Contractor but I think Carlawarla assumed military.

I have no experience of this at all but I think that information might help to get you an accurate answer.

It wouldn't be a problem if your husband is military. You will have a more difficult time showing a valid relationship if the separation is by choice.

Fiance is a DOD contractor..has anyone had filed aos where the petitioner works overseas???
