AOS Filer based on K-1 Visa, Nov 2008

Timeline

Hi everyone,

My USA husband and I just got married on Nov 15th, on the 89th day of my 90day K-1 visa. We're living in Texas.

I'm currently feeling overwhelmingly stressed about getting together the I-485 application for AOS.

Questions:

1. Do I actually take out and send the I-94 departure record white card from my passport?

2. "copy of your marriage certificate" - does this mean the CERTIFIED one that you receive a a few weeks after you send your marriage license, or just a copy of the signed marriage license?

3. Am I going to be in trouble / deported for not having the I-485 AOS before my visa expires? On the sheet they gave me in Sydney regarding what to do when I get into the USA, it just says, "You must (then) apply for resident status as soon after marriage as possible (by contacting the nearest office of the USCIS)" ....

Urgh, please stop me from having a nervous break-down...

Can anyone shed some light and put this poor newly-wed at ease...? :mellow:

03.20.2009 - AP RECEIVED!!!!!!! HOORAY!!

03.27.2009 - EAD received in the mail! :) time to get ssn and drivers licence and A JOB!! w00t!!

04.02.2009 - Welcome Notice :)

11/30/2010 - USCIS sent my 'Notice of requirement to file joint petition to remove the conditional basis an an alien's permanent resident status

12/24/2010 - Application package sent

12/28/2010 - NOA1 Receipt

05/16/2011 - Approval of Permanent Resident Status!!!! :)

N-400

11/01/2012 - N-400 application sent

11/07/2012 - Email confirmation application was accepted

11/08/2012 - Cheque deposited

11/12/2012 - Received Form I-797C, postmarked 11/08/12

11/16/2012 - Completed biometrics

02/27/2013 - Interview

03/27/2013 - Oath ceremony

You need only send a photocopy of the I-94. You can purchase additional certified copies of your marriage license from the issuing office, and it's best to have 2-3 of them available. Send one to the USCIS. As soon as you submit your I-485 and get the receipt (NOA) from the USCIS, you have the necessary document to show anyone that you are here legally.

2) a copy of your "certified" marriage license

3 NOV 2008- I-485,I-131,I-765 sent to Chicago

13 NOV 2008- check was cashed

18 NOV -I got 3 NoA for my papers dated 13 Nov 2008

24 NOV- biometrics NOA

4 DEC- biometrics appointment

13 DEC- RFE (tax papers)

26 DEC, 31 DEC, 8 JAN- biometrics had to be retaken :(

9 JAN - Case processing has resumed

4March- AOS Interview NOA

7 APR- green card interview -approved

I-751- conditions removal Vermont SC

19 Jan -sent the package

21 Jan- the package was received by USCIS (NOA dated 1/25)

28 Jan- check was cashed

24 Feb- Fingerprints Appointment

6 July - Approval notice

9 July - Green card received

I'm a native Texan so let me shed a little light on your marriage license in Texas. All states are different.

We were married in October, so I just went through this. You go get your marriage license at the County Clerk's office (which I suppose you did). When you marry the officiant (minister, judge, etc) signs that he performed the marriage. Then the marriage has to be registered or recorded back with the county. Sometimes a minister will mail it in. Or the couple can do that. The day after our wedding, we took ours back in person to the same office where we got the marriage license. The clerk registered it in the official records and put the county seal embosser thing on it. That is now your marriage certificate. It's the same paper as your marriage license, but it has been signed by the person who performed the marriage and recorded with the County Clerk, and embossed. At the same time we took it to be recorded, we ordered a certified copy. That is just a photocopy they make, with a signature area at the bottom saying it's official from the County records, and they emboss that too. I think the certified copy cost $20.

If you mailed your license in, they will record it and mail it back to you. To get a certified copy, go back to the County Clerk's office and ask for a certified copy. It should be on record and they can just pull it up and print the copy and do their official signing and embossing.

Mail a certified copy with AOS. That's all that has to be certified. Everything else can be photocopies.

(If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)

with the forms may tell you! Ignore the instructions regarding a medical exam after entry on a K-1 fiance
