You assume my future wife saw the required form and failed to comply. We never received packet 3 and my lawyer submitted it for her. She has some difficulty reading english hence the reason I hired a lawyer to help her with her side of the paperwork.

She had to sign the documents at some point, and the new Packet 3 is written in Thai. Of course the lawyer may not have had her read it before she signed it.... another reason to fire him.

That and some other reasons we haven't gone into.. He was great helping her obtain the police reports, medical and translating documents and like you stated... telling her where to sign but the staff was lacking and it was like pulling teeth to get info from him or even a response. Plus I had the feeling like I was cattle or a number.

I also found some disturbing info about him after the fact... Guys, hit me up if you want to know more and are considering hiring a lawyer in Bangkok.

She had her interview.... only asked her a couple of questions... how did we meet, Where, how many times have I come to visit her? (7 times) They told her everything look good but they need proof that she is not married??? How do you prove a negative????? :mad:

We had a great application... tons of proof...photos galore... I have a great job and plenty of money and was told by attorney that our app was one of the best he's see and that it would have been a slam dunk.. Not in this world!

They said they were surprised that she is 30 and not married yet. She also stated that the guy interviewing her was rude.

Now she has to travel back to her home village in Ubon Ratchathanee "on the other side of Thailand" about 8 to 10 hours away and ask her city hall to provide a letter of guarantee that she has not been married before. When she gets that she can come back on Monday or Wednesday and hopefully they will give her the visa and not ask her to come back in a couple of weeks after administrative review.

They even told her everything looked good.... SO FRUSTRATING!!!

I was told by my attorney in Bangkok that they only normally ask for proof of single when a child is involved but she doesn't have children.

Good luck everybody and don't take anything for grated when it comes to dealing with the US Embassy in Bangkok... Even when EXTREMELY diligent and providing overwhelming amounts of proof and supportability.... they can and will throw you a curve ball!

I think they had too many Visa to process that day and they decided to push her back a week to lighten their workload. However they are not taking into consideration the heartache and the hoops the applicants are having to jump through to make their dreams happen. All after waiting 6 months to be with your loved one.

I'm done ranting.. Hope this has some use for someone.

This is one of the documents that is required and it is listed in the Packet 3 checklist.

I don't know ANYONE that went to the interview without it.

My fiancee had to have her parents come and sign this form attesting to the fact that she has never been married. I'm not sure what the procedure was for doing it, but she knew what to do.

And maybe they weren't being rude. You fiancee is very pretty; I'm surprised she's not already married myself... haha... Well, good luck!!

My wife was interviewed & granted a K 3 visa last year & we were not asked for any form saying she wasnt married before even though she has a child. They did ask if she had been married & she answered no.

It could be that the rules have changed from that time to this or the fact that she had her new passport with her married name. Also I was present at the interview.

Firing the lawyer is a great idea.

Like pushbrk said, when you apply for a K3 visa you are ALREADY married and therefore cannot document that you are NOT already married. The OP applied for a K1 fiancee visa and needs to supply slightly different documentation.

I think my post is clear in its message & intent & the OP knows what visa he applied for. I dont pretend to know the proceedure for K 1 visas because I didnt apply for one. However a Thai friend is here on a K 1 & was not asked to submit the document you say EVERYONE needs.

If pushbrk is correct why do you feel the need to parrot his advice? We get the idea that your are a a great immigration sage & we cant make it without your advice.

The OP paid a lawyer that he thought & hoped was doing the work needed including reviewing the packet 3 docs.

She just called me...

She purchased a plane ticket and traveled to Ubon shortly after her interview yesterday. She Just got back from wherever she need to go (city hall??) and acquired the letter of guarantee that she is single and never been married.

I am flying to visit her on Friday and will be with her on Monday when she turns it in.. I doubt they will let me in but I will try. Hopefully she will be on the plane with me on the 30th.

However a Thai friend is here on a K 1 & was not asked to submit the document you say EVERYONE needs.

The US EMBASSY (in Packet 3) says that everyone that has not registered a prior marriage needs it.

If pushbrk is correct why do you feel the need to parrot his advice?

Because you are posting information about what happened with your wife's K3 visa even after he pointed out that whatever happened with a K3 visa is not relevant in this case.

Your post may make others think that they can skip this document as well. That would not be a good idea.

Married people are never asked to provide a document certifying they are not married because to comply with such a requirement would be impossible BECAUSE they ARE married.

P3 instructions for K1 visas in Thailand indicate the need to submit what we generically refer to as a "CENOMAR". The PI and China require them to.

This is never a requirement for a spouse visa. Spouses prove any previous marriages have been terminated.

I didn't see this form and if this is true I am greatly disappointed in him.

A successful visa process requires a lot more than meeting the requirments but failing to submit a required document is a perfect formula for failure. Government certification of single status is required in some countries and Thailand is one of them. Your fiance saw the P3 and failed to comply.

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

It's not required for K-3 or CR-1 visas. The kids both had to have some documentation that they were single and free to marry when they registered with the Amphur, that is, officially got married, but not when she applied for the K-3 visa. Being free to marry is a condition of the K-1 visa. In that case Bangkok requires proof. In our country polygamy is illegal.

I'm not sure if Thailand is the same as Philippines (I understand Philippines is substantially more strict) but how old was the original document that she had to update?

I just know found out (after she seen the document again) my fiance read and asked our lawyer about the very document in question. He told her that you do not need that cause you don't have children.

She is very angry and confronted him about this... now he says the embassy had a change recently... more bs
