K1 has expired, waiting for AOS receipt...can she travel?

Hi,

My wife and I got married last month, and her K1 status expired yesterday (her I-94 says "Class K1 until Nov. 18, 2008"). We just sent in her I-485 AOS application last week, so we haven't received the I-797 receipt from the USCIS yet. I know, we should've sent in the I-485 sooner...my bad.

Anyway, we're flying to Boston next week for Thanksgiving, and the only form of ID my wife has is her foreign passport. Will she be ok at the airport with that? I'm afraid they'll flip to the visa page and see that her K1 status has expired and not let her on the plane. I have our marriage certificate which shows that we got married within 90 days of her arrival into the US. Will that be sufficient?

Wow, 3 years! I guess my main concern is that we really don't have anything official to prove that my wife is in the country legally. I hope it works for us, too. Worst case, we'll just drive to Boston. Thanks, and happy Thanksgiving!

Wow, 3 years! I guess my main concern is that we really don't have anything official to prove that my wife is in the country legally. I hope it works for us, too. Worst case, we'll just drive to Boston. Thanks, and happy Thanksgiving!

It's not the job for TSA to enforce immigration issues. They only need to make sure that the name on the ticket matches the name on a valid government issued ID.

It's not the job for TSA to enforce immigration issues. They only need to make sure that the name on the ticket matches the name on a valid government issued ID.

There is theory and then practice... The TSA has been reported to have inquired as to immigration status in the past... They even mention on there website how the ID checkers have "caught" illegals (after reasonable suspicion and probable cause). There are also reports that the TSA has "dialed" down this practice of "status" checks of late after complaints....

So you will most likely be trouble free... but simply be aware....

I don't understand something... How can your wife have an ID if she doesn't have EAD or GC? Personnally, I cannot have any American ID for now.

Another question, more general, about the name on the plane ticket. My passeport has my maiden name on it, but my NOAs have my married name. What name should I registered in. If I put my maiden name in order to match my passport then they don't match my NOAs, so it's not good right? Should I bring my marriage certificate too then?

Her current form of ID is her Korean passport. They should accept that at the airport.

My wife didn't change her last name, so we don't have that problem B) . I'm not sure what you would do in that situation. I would buy the plane ticket with your maiden name so that it matches your passport since that's probably the only form of ID they need to look at at the airport.
