hi all, i hope everything is going well with you. I got the 2 yrs green card one month ago. Sadly i think we are going this time towards a real divorce, i said real as we mentioned divorce before and didnt happen. After fights and lots of misunderstoods like what happen between a big amount of human couples. some of problems because of me although i know am a good guy but my stupid bad temper sometimes and the lack of handling problems and when my feelings get hurt, without yelling. Some because of her and i know no human is perfect, some because like i said of misunderstoods and other stuffs. I feel a pain that i wanted to make something great and people happy but i find i just mess. anyway after saying some of my personal story to you i want to know, if the divorce happen and i have to apply , is sending the tax papers is a must? i came here in the end of 2007 i didnt work till august 2008 ,so if the divorce will happen, it will be before filing taxes. She has the majority of bills in here name, my name is in the lease and in the inssurance card with her name,i have copies of our credit cards, photos together and with our families, letters ,emails greeting cards ,phone calls history from the time we met. I have the selective service system registration card showing the home addresse. Her father is the co sponsor and he worked in the dept of defence ( say this meaning it is not a fake marriage),i really do love her but i know being bad and yell ( i dont insult) none would deal with it , sadly i was like that with my family too. At the end i want to know after the divorce, will it worth it to try apply ,pay and deal with that headache thing again, or i shoud just leave, go back and start a life between my family again, better than get deported as it is humalating in my opinion.

thank you if you stop to reply or even if not, and i hope that you guys try hard in your marriages.

Unless you have a good reason to stay in the U.S., going back home might be the simplest thing to do. Let her file for the divorce and once it's granted, you are free to marry again. Even going back home for a one-month visit might help both of you get a handle on your problems with each other. Another choice is to get counseling for anger management -- it sounds as if this has been a problem for you most of your life. It would be covered by your health insurance, if you have it. Good luck!!

If you still love her then why not seek marriage counseling before calling it quits. Everybody has problems and the beauty is that if you both still have the desire, why not try to save the marriage.

i dont know why u see it silly , i said that meaning that he is the co sponsor and he worked in a gov job so if it is a fraud marriage and just a deal between me and her , he wouldnt be the co sponsor, i said that in case the immigration people would think it is a fraud marriage or a deal, i dont know how to explain it. I read in here that the immigration offices care about the nature of marriage was it real or a deal, the divorce anyone in the world can divorce.

Newsflash: that was just an opinion or ( thinking out loud) and both of you talked about it.Because the immigrations ask us and want any evidence, small or huge ,stupid or smart, there are people who were asked what was the last time u had SEX.So when i was talking and saying that this marriage we both entered in it with good faith, i mentioned that the co sposnor is my step father and i mentioed what was his work, means that IF the officer thinks it is a fraud ,AT LEAST who is the co sponsor and what was he doing can a lil bit a lil lil lil bit show it may not be a fraud ,as first of all i dont think any father (unless he is stupid) can accept to let his daughter doing fraud, second someone who worked in the gov and served wouldnt does fraud.

U left the main subject that i wrote and u stick with that opinion, u have the right to say whatever u want, but u dont have the right to joke or try to look smart on someone else opinion, thank you anyway. We r not going to the divorce right now we are trying ,working and building and i hope the devil will leave our relationship alone. If it will be a divorce i may just go back without files headaches,i seek and want just one heaven, the one there ,far from the sky,as there s no heaven on earth.

Take it easy LEN u seem bored and nervous.

Thank you all for ur replies, problems happen to humans this is natural, best luck for u.

I guess the point is that USCIS might see it as fraud on your part but not on hers, in which case her father's occupation does not matter. See, sometimes the USC is not aware of the fraud until marriage suddenly falls apart, often just after the green card is issued. And USCIS is well aware of this.

I do hope you two are able to work it out. Divorce is very painful for everyone involved.

I'm sorry to hear that it looks like things are not working out. I think the suggestion of a long visit home, about a month or so, is a good one. You're able to do that with the green card without getting advanced permission to return.

If you both decide to definitely proceed with the divorce, then you need to decide whether it's best for you to return home or continue a new life in the states. If the divorce goes smoothly and she does not want to try to prevent you from staying in the US, the process of lifting conditions shouldn't be too bad. You can get more info in the "Effects of Major Family Changes on Immigration Benefits" forum here. :)

listen dolphin, immigration needs a realistic prrof of divorce or failure of marriage. they don`t believe that marriage didn`t work out.. most likelythey will send you home if you divorce and apply for removing condition...unless you provide a proof of your spouse abuses you and hurt you ...try on saving your marriage as much as you can if you can`t , go for divorce but chances of staying in usa are very weak...i hope you guys work it out....good luck

I don't think your father in law's (being the co-signer) occupation means anything to immigration. And just because he works where he does doesn't mean that there wasn't a fraud. However, I do agree with a few of the others, if you love her like you do, try counseling. Its a shame that so many marriages split up the way they do and they could have been saved by counseling. Good Luck!
