Hi everyone,

Can anyone help me out on what's the fastest waiting time as far as you know in bringing spouse here in US with a pending I-130?

I am a green card holder.

I have a pending I-130 case for my wife that I think we still have 1 yr and 3 months of wait as of this time before we can get a visa number available.

I applied for naturalization last month of October 2008.

Which is faster? Shall I wait (1 yr, 3 months) for the visa to become available? or shall I upgrade my wife's I-130 once I become a US citizen (which I just applied October 2008)?

If you think upgrading her I-130 is faster, what form/s or application will I use the fastest? Shall I apply another I-130? K1/K3, IR-1CR1? I have little idea on these and how to apply it on my case. Don't know what route to take the fastest. Any help is truly appreciated. Thank you.

Does your I-130 petition for your wife approve already?

If not, after you receive the certificate of naturalization, which means you becoming US citizen, you can send cover letter asking the I-130 case upgrade from F2A to IR1/CR1 along with the copy of your certificate of naturalization.

If your I-130 is approved before that time, ans forwarded to National Visa Center, you can send same thing to NVC.

USCIS approved her I-130 already and currently sent to NVC. So what do I do next? Wait for my naturalization and call NVC (or is it USCIS?) to upgrade from F2 to IR1-CR1? So this is the quickest way? Thanks.

Since her petition has already been approved by NVC, right after your oath you can call NVC that you recently became a US Citizen and that you would like to upgrade your spouse petition. Then you will need to send them a letter to request upgrade with the copy your naturalization certificate and NO2. You can either email, fax or mail it (but i suggest to do all).

This is way quicker than anything else, specially that her petition has already been approved. Once they received your request they will send you a confirmation then they will start sending you Choice of agent, AOS fees and etc.

Since her petition has already been approved by NVC, right after your oath you can call NVC that you recently became a US Citizen and that you would like to upgrade your spouse petition. Thanks.. clarification: the petition was approved by USCIS (not NVC yet), and currently in NVC waiting for NVC approval, but perhaps it is just a typo on your part ;). But nevertheless, I see what you mean, thanks. So while the I-130 is pending in NVC, I have to complete my naturalization.. after oath, call NVC to upgrade.. Send them letter of request, naturalization certi and NOA2 (this is the NOA that indicates that USCIS approved the I-130 and being sent over to NVC?). So this is the quickest way huh, this is the same as IR1/CR1 right? and once they got the request they will send me requirements i need to procure. Ok got it, thanks a lot. And by the way, do you know any resources on how-to/what to include in the letter of request?

Just wanted to say though, for those who are upgrgading there petition and have only received NO1. You can also use the above sample letter but addressed it to USCIS rather than NVC. There is no use to send a letter to NVC if your case is still with USCIS. NVC will just inform you that they do not have a record of your case. But once you received the NO2, your case from USCIS will be transfered to NVC.

Just wanted to say though, for those who are upgrgading there petition and have only received NO1. You can also use the above sample letter but addressed it to USCIS rather than NVC. Yes it will be faster if he upgrades the petition after his oath, because a visa number will immediately be available for you.

Yes it will be faster if he upgrades the petition after his oath, because a visa number will immediately be available for you.

Yes it will be faster if he upgrades the petition after his oath, because a visa number will immediately be available for you.

hello... happy to know we have the same situation here, so that we can share our journey in this visa thing..our case is still in the USCIS, we are waiting for the approval of it: this is how it goes ...My husband filed I-130 to me last June 2008 when he was still an LPR, he got his US citizenship last Feb. 26, 09..day after that my husband went to the local immigration office in CA to upgrade our case, the lady who entertained him fax the request to the USCIS..( Feb. 27 ).. we still did not hear anything about it, we are waiting for its approval from d USCIS and our NOA2... in fact my husband also send another fax last mnth to the USCIS in case the first one doesnt work.. just to make sure.. we are waiting now for any response..., how about you? ive read from some post that usually it takes 2 months for it to be approved, but some are 1 month half, some are more depend on d case...but USCIS processing time is 6 months...

It can take only a few days or months,being that USCIS is speeding up all the cases now,it shouldnt take much long.Here is my experience

I upgraded my I-130 on Oct 24th,2008 and it was approved on Feb13,09(FINALLY)So it took them a while to upgrade and approve it.I used to call USCIS every 3 or 4 days and they used to put service requests all the time.I did info pass in dec and the lady told me their system still showing me as a LPR.Wrote letters,calls,contacted congress lady and was about to contact the senator.So it can be a hassle ,make sure you verify when the case was upgraded,i used to get different answers every time.Any questions,dont hesistate to contact me.

Did you call the 1800 beside faxing the letter.
