AOS Interview - are they supposed to keep my I-94?

Hello, this is my first time to post on VJ.

We had our AOS interview this morning and I think it went well. The interviewing officer was really nice and she didn't seem to have doubts about the nature of our relationship. (We've been together for 4 years and have been living together for almost 3 years, so it shouldn't look suspicious anyway.) The interview lasted maybe 10 to 15 minutes. She didn't ask difficult questions at all and didn't even look at our photos until I voiced my dissapointment (I made a really nice wedding/honeymoon photo album and it took me days to finish it up).

Anyway... After I got home, I realized that my I-94 was missing. I have all other documents I brought to the interview, so it must be on her desk. I tried to find a phone number for the local office, but I couldn't, so I called the USCIS customer service. After going through a really long, confusing automated menus, I finally reached a real person, but she told me she didn't know whether they were supposed to hold onto my I-94 after the interview. So I made an appointment tomorrow to speak to an officer at the same office.

I was just wondering if anyone had a similar experience. If so, would you be kind to tell me your story? I hope I can find out what happened to my I-94 tomorrow, but I am really nervous... :(

As I have read, it seems common for them to take your I-94. Seems they usually take the I-94, EAD, and AP.

May 13 2008 (Day 1) - I-130/I485/I864/I765 Sent Via USPS for my new wife and step-daughter

May 23 2008 (Day 11) - Checks Cashed!

May 24 2008 (Day 12) - Received NOAs for I-130s/I-485s/I-765

May 27 2008 (Day 15) - Received Biometrics Appointment for June 12th @ 1PM at Tampa Office

June 12 2008 (Day 31) - Biometrics conducted in Tampa USCIS office also I-485 and I-765 TOUCHED!

June 18 2008 (Day 37) - I-130s and I-765 TOUCHED

June 24 2008 (Day 42) - That touch was actually an RFE letter being mailed. RFE for I-864 Evidence

July 16 2008 (Day 64) - Finally mailed back RFE letter with requested evidence

July 18 2008 (Day 66) - RFE Evidence delivered! Signed for by M. Miles

July 22 2008 (Day 70) - I-1485s TOUCHED and Received E-mail "Case Processing Resumed"

August 14 2008 (Day 93) - EAD Card Production Ordered!

August 15 2008 (Day 94) - I-765 TOUCHED

August 19 2008 (Day 98) - I-765 "EAD Approval Notice Mailed"

August 20 2008 (Day 99) - EAD CARD ARRIVED! - Applied for Social Security Number!

August 26 2008 (Day 105) - Received SSN - Took tests at DMV for License - Told license will arrive within 30 days by Mail

September 22 2008 (Day 132) - Received Driver License in mail - They sure took their time mailing that out!

October 11 2008 (Day 151) - Received Interview Letter for November 19th @ 7:00 AM

November 6 2008 (Day 177) - I-485s and I-130s TOUCHED

November 19 2008 (Day 190) - Had interview, APPROVED! Interview took less than 10 minutes

December 5 2008 (Day 206) - GREEN CARDS ARRIVE!!

Yes, they took my I-94 at the interview. Before you were approved, it was the only thing that showed that you entered the country legally, but now you are approved you'll have the green card to demonstrate your legal status, so you don't need it anymore. From what I have read, it's common for them to keep it in your file as proof you entered legally.

Removing conditions:

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18

Yes, they took my I-94 at the interview. Before you were approved, it was the only thing that showed that you entered the country legally, but now you are approved you'll have the green card to demonstrate your legal status, so you don't need it anymore. From what I have read, it's common for them to keep it in your file as proof you entered legally.

thank you! the officer didn't tell me whether we were approved or not, but i am optimistic from the way she spoke to us. she told us that we'll hear an answer in 4 to 6 weeks.

i was in shock when i got home - i couldn't believe that i didn't make sure that i had my I-94! 7:30am appointment was a bit early for us and i guess my brain wasn't functioning 100%. :D

They also took my wife's I94

Keep an eye on your case status....ours changed to "approved" sometime during the night after our interview.

I watched my IO take the I-94 from my passport, and sometime through the interview i mentioned it and she gladly told us that we were approved so there was no need for the I-94. Congrats! Oh yeah and my online status changed the next day to card production ordered. I wouldnt worry about making a trip back up to the office tomorrow. They will tell you the same thing.

May 26th, 2008---AOS/AP/EAD sent

May 29th, 2008---Package Received

June 7th, 2008----4 NOAs Received

July 3rd, 2008----Biometrics App

July 11th, 2008---Medical Completed

Aug. 14th, 2008--AP Received

Aug. 21st, 2008--EAD Received

Error Found on EAD :(

Sep. 30th, 2008---Correct EAD Received

Oct. 1st, 2008-----Interview Date Received

Oct. 17th, 2008---SSN Received

Nov. 7th, 2008----AOS Interview

Nov. 14th, 2008--Welcome Letter Received

Nov. 21st, 2008--Received Green Card!!!

i actually went ahead and canceled my appointment after reading the replies. thanks for the advice! my IO didn't tell me if my case was approved, but it sounds like what happened today is a good sign, so i am waiting anxiously... :)

The I-485 cannot be approved without the approval of I-130 so don't worry about it! You are good to go. Congrats!

thanks :) i was really confused, but i think it's about time i stop worrying about USCIS. for the past few days, i've been making lots of copies, reading everything over and my head is spinning... :wacko:

i can't wait for the day the GC arrives. i guess i will get a notice about getting my passport stamped after this happens? i really should stop worrying so much and relax my mind for a while ;)

If you are K3 they shouldn't have taken the I-94. They screwed up and took my wife and daughters K3/K4 and told us they'd have to get AP to travel. Luckily they got their GCs quick.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

For me, after AOS Interview, IO has cancelled(without prejudice) H1B/H4B and mentioned that we are on Intent Immigrant status, hence we dont need it.

My EAD/Advance Payrole are expired. What is my current status? What are my options for renewing EAD and Advance Payrole, is it safe to do so at this stage or should I wait for GC. I am working on H1B and continue to plan to do so with same employer
