Current K3 processing delay?

lol girl 37 they change the

"these cases are currently taking between 60-90 days to process" (or whatever the exact wording was) to this (below) was not a good sign.

so you would not call them and say its been 90 days whats taking so long. Man they better update these dates on monday or i'll go crazy insane.

I know! :lol: I'd already programmed their number into my speed dial so I could call them up and ask #######?? exactly 90 days after our date, and now they've gone and changed their tune. :hehe:

I don't come from a "let's sue them!" type of country (as I always tell my husband), :innocent: but right now I wish someone would launch a class-action suit to get the process moving again.

right on. a big mahalo to everybody for sharing their knowledge and insights on this quandry. It seems like there is a lot of positivity and good vibes here, all in contrast to the torture we're concurrently experiencing... thanks again for all the constructive input.

however, I have to admit i was hoping to hear something more like, "they've been so busy typing up approved visas that they haven't had time to mail them out." yeah, right.... i can't figure out if it's just better to bury my head in the sand and not hear any bad news or to keep on trying to figure out what's up. I'm so bummed. If i were a button, i would be de-pressed.

Maybe we should turn this around and send the USCIS our own RFE, a Request for a Frickin' Explaination.

Or what if we send them some fresh baked cookies or banana bread or something along with a note saying "there's a lot more where that came from if you start working again. please."

the ironic thing about all this to me is that, I'll bet most of our spouses would make way better us citizens than a lot of people born here (myself included)...

getting back to the basis of this topic though, does anyone have a good estimation or inside tip on what they may be asking us for in the near (hopefully) future in response to this IMBRA nonsense? Does it matter if you met your spouse socially as opposed to over the www? These guys are killing me the way they change the rules in the middle of everything and then we have to suffer the consequences. It's kind of like trying to play poker with a little kid. Ahhrgggg.

Ok.....heres the biggie.....every K visa petition I-129F (fiance or spousal) comes under the IMBRA regardless of how one meets.

At least they are not requesting return of K3's already processed!

The document you quote from is a DOS memo to consulate posts......their wording not USCIS. All the returned K-1 visa petitions all came from VSC which is renowned for its speed......hence why there were none from the other centers recalled. All that memo is saying is that USCIS didnt request any K-3/K-4 I-129F petitions be returned. NBC being slower like the service centers (bar VSC), most likely no approved petitions had been sent to consulate posts past the 6 March. If you look at the VJ timelines eg for K-3........no I-129F has been approved post 6 March that I could see. VSC just got ahead of the game.

Hello,

I received my NOA1 for the I129F on March 13, and still have not heard anything about the NOA2. My I130 was approved on 5/4/2006. I called the NVC on May 20th and I was still not in the system. What is the process after the I129F is approved? Do I need to file for the I485 AOS at this time? I am so confused at the process it is not funny. I am lucky and happy that me and my wife have patience. I wish I could find out some straight answers from the people when I call. I guess it will be a few more months before she gets her interview in Bogota. If anyone out there has some accurate information, please pass this along. Also, what is the IMRA, is this the new guidelines for Immigration? If so, where can I get some information as to what these guidelines are.

I-129F once approved (NOA2) will be forwarded to NVC where it stays generally for only a short time to be assigned a case number. It is then forwarded to the embassy/consulate. When visa is granted and entry to the US on the K-3 that is when Adjustment of Status (I-485 etc) comes into it. This is a nonimmigrant visa and will also entail getting EAD etc after entry.

I-130 once approved goes to NVC and assigned a case number. See NVC FLOWCHART for the NVC process. Also have a read of the NVC Timesavers & James Shortcuts The I-130 is CR-1 immigrant visa which means a green card and no adjustment of status on entry to the US.

I was under the impression that IMBRA was for fiancée visa, a 130 is for people tat are already married and even if we have to go with the 129F it should be deferent, I mean it is to protect the immigrating spouses from the Americans that are criminals, and that have meat using a marriage broker and if you are already married why should this effect us????

I agree with you. A fiance(e) can have a 2nd thought before marriage, but those who are already married, what they can do? Divorce?

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

There actually has been talk of a class-action suit but it surely wouldn't do anything more than bring attention to this enormous screw-up on the part of DHS.

In the meantime, there are several people on the Fiance Visa forum who had their petitions returned from the consulate just as they were about to go the interview. They have done a tremendous amount of research and digging around on the DHS website, talking to senators, etc. The most recent update is that DHS has requested emergency approval of a new I-129 form. This, apparently, will be the way they request the additional information they require in order to comply with IMBRA. It's still unclear if this new form will be provided to petitioners to indicate their "possible criminal background" or if it will come in the form of a Request for Evidence.

The hope, of course, is that one of these days DHS will actually see fit to contact petitioners who filed after March 6 to provide information on the situation as well as the form. Keep an eye on the K1 forum for up-to-the minute updates!!!!
