Current K3 processing delay?

aloha,

Does anyone out there know or have an idea why the current k3 processing of NOA2's seems to have stopped at 03 March 06? Am I misreading the timeline table? I look at that column (NOA2) every day and haven't seen any progress since that date. From the VisaJourney timeline database, it appears that no one with a receipt date after 03 March is reporting an NOA2... And from the information I've read from the NVC and elsewhere so far, I'm under the impression that K3's ought not to be affected by that IMBRA or whatever recall episode (i'm hoping...)? I also saw reports in this forum of broken machines to make the receipts...? How hard can it be to print something? I'll buy them a killer new printer myself and send it to them if that's the only problem. Or did space aliens come down in flying saucers and abduct all the USCIS workers and replace them with alien (space, not illegal or resident) clones...? If so, I hope they're getting a decent "probing". Any constructive comments, suggestions or ideas would be very welcomed...

15 MAR 06 Tried to get her a tourist visa in Bangkok. No dice. I was a lot less informed at that stage.

03 APR 06 Sent I-130 to Cali

07 APR 06 I-130 Receipt Date, as printed on the I-797 NOA1

10 APR 06 Sent I-129f along with a prayer to Chicago

14 APR 06 I-129f Receipt Date, as printed on the I-797 NOA1

That's all I got... (so far, I say optimistally)

I check the USCIS website constantly--it's 100 times worse than watching paint dry. I know it's not going to change, and yet I still look at it about 5 times a day. I'm such a mooron. I really wish I knew what is going on over there at the MSC. I think my petition is just laying untouched on some clerk's desk, possibly serving as a doughnut napkin or drink coaster. It's breaking my heart.... They have a lot of people's lives in there hands, I can only hope they're cognisent and respectful of that fact. I really need my wife. She's my saviour.

Sorry for all the personal notes, i'm just finding it so therapeutic to actually write these thoughts.

K-3's unfortunately come under the new IMBRA (as do K-1s), which came into effect on 6 March. All I-129F fiance and spouse petitions with a receipt date of 6 March and later are affected. For more on the IMBRA see the K-1 Forum. I-130's for CR-1 are not affected.

Patience , patience ,patience .... it pays. Take a look at my timeline , it took them almost 90 days to approve our I-129F , but they approved it. I was in the same situation as you , going to USCIS website on and off every 5 minutes and gain nothing but stress. Hang in there and good results will come.

Welcome to the club of the insane, I check my status, the processing days, and VJ estimate processing date, more than 100 time a day, I even get up in the middle of the night to check, the wait is hard but it will come one day, be patient, I know that its easer said than done, and good luck :whistle:

About K-3: NBC is processing March 05, 2006 per its May 22 update. Next update will be sometime next week when we will know about a new processing dates which would give us some ideas about how much the K-3s are being affected. DHS has not recalled K-3/K-4 petitions from the Embassies yet, but it does not mean they DHS won't recall K-3/K-4. Right now, no one knows anything clearly. In the meantime, take a deep breath and stop taking stress.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

DHS has not recalled K-3/K-4 petitions from the Embassies yet, but it does not mean they DHS won't recall K-3/K-4. Right now, no one knows anything clearly. In the meantime, take a deep breath and stop taking stress.

If there was any K-3's to recall they would of done so. From the stats so far on VJ all recalls seem to of come via VSC, being as they are fast in processing. NBC was probably as the other centers were and there was none to recall. K-3 visa petitions unfortunately are just as affected by IMBRA as K-1's.

Well, i still dont believe that the IMBRA will take so much affect on pending petitions...of course just as long as your criminal background is ok :P. I talked to my husband and he knows those procedures to check a persons background does not take very long. So relax everything will be good soon.

And how do you propose they are going to get that information? Yes USCIS has access to various data bases and they already do conduct name checks on the petitioner as well as the beneficiary during the normal processing of a petition.....something completely different then now where they have to meet the requirements of the IMBRA. They will still do same data base checks but the petitioner must acknowledge these requirements of the IMBRA and this will come in the form of some type of RFE........how that comes is what is open to conjecture.

umm... right. I'm glad your husband's on top of it. I'm creeping up towards 90 days past my NOA1 date for the I-129F, and almost a month past people who submitted their petitions a few days before me and received their NOA2s. At this point I'm not counting on getting the K3 before the CR1, that's for sure. :clock:

The change from "these cases are currently taking between 60-90 days to process" (or whatever the exact wording was) to this (below) was not a good sign.

Your I129F PETITION FOR FIANCE(E) was received on March 10, 2006. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

meet IMBRA requirements...well I still dont see why they do that check on married couples as well since they are already married.....are you supposed to get a divorce then or what??? Hm....weird but anyway, I forgot about that fact....but since K3 petitioners didnt have to tell them how they met what a difference makes it now to ask how they met...that is confusing. I dont see the bottomline of that.

Ah and true RFE would be good regarding to fiancee petitions that have still been filed with the old petition...so pretty much all of em.

God I wish they would come out with something official!

I received my NOA1 for the I129F on March 13, and still have not heard anything about the NOA2. My I130 was approved on 5/4/2006. I called the NVC on May 20th and I was still not in the system. What is the process after the I129F is approved? Do I need to file for the I485 AOS at this time? I am so confused at the process it is not funny. I am lucky and happy that me and my wife have patience. I wish I could find out some straight answers from the people when I call. I guess it will be a few more months before she gets her interview in Bogota. If anyone out there has some accurate information, please pass this along. Also, what is the IMRA, is this the new guidelines for Immigration? If so, where can I get some information as to what these guidelines are.

I-129F once approved (NOA2) will be forwarded to NVC where it stays generally for only a short time to be assigned a case number. It is then forwarded to the embassy/consulate. When visa is granted and entry to the US on the K-3 that is when Adjustment of Status (I-485 etc) comes into it. This is a nonimmigrant visa and will also entail getting EAD etc after entry.

I-130 once approved goes to NVC and assigned a case number. See NVC FLOWCHART for the NVC process. Also have a read of the NVC Timesavers & James Shortcuts The I-130 is CR-1 immigrant visa which means a green card and no adjustment of status on entry to the US.
