Hello,

I am posting this for a friend of mine who is in the process of bringing his wife here from Colombia. He is internet challenged. He has a K3 Visa application I-129F along with his I-130. He is wanting to withdraw his 129F and wait out the CR1 (I-130). Is this a smart thing? They are asking for a reason for his withdrawal. What should he say? Waiting for CR1 to be approved.

As for me, my wife 130 was approved before the 129F so it was not an issue. She is here with me now.....yea!

VSC told me not to withdraw I-129F because it can cause problems for the I-130 petition process. It is his option to withdraw but there is not really a need for it. All he really needs to do is wait. Eventually the I-129F will be approved, sent to NVC, touched, and then sent to the embassy. The embassy will then send the spouse info. All the spouse does not have to do anything. That is where the I-129F will stop. Just move forward with the I-130.

November 7, 2008 - I-129F & I-130 petitions recieved at NVC & NVC says I-129F forwarded to Consulate

November 13,2008 - I-129F appears to have been shipped via DHL website on this date, Tracking #: 9486375732

November 17, 2008 - DS-3032 & AOS Fee Bill generated

November 18, 2008 - DS-3032 overnighted to NVC

November 22, 2008 - IIN received in mail; Paid AOS & IV Fee Bills online

November 25, 2008 - AOS & IV Fee Bills rejected; Paid Fees again online (now pending)

November 26, 2008 - AOS & DS-230 packets overnighted to NVC (payments show as paid)

December 16, 2008 - K-3 Visa Interview (now cancelled)

December 2, 2008 - Case complete @ NVC; waiting for interview date to be set

January 16, 2008 - CR-1 Visa Interview

Very good. Just do nothing and let the I-130 cruise on through. I was afraid that withdrawing the 129F might mess up the 130. My wife came here approved and has resident card and SS#. I am so glad that I didn't have to do the adjustment of status and all of that stuff.

You were right. However, if your wife has a green card without adjusting status, she didn't get a K3 visa as your profile states. Please correct your profile to reflect the actual visa she used.

Isn't it still a concern that the I-129f could be approved and reach the NVC before the I-130? I thought that if that happened, getting the I-130 pushed through took another form, a new fee, and several extra months.

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

No, there are no extra fees for the I-129F petition being approved first. It will simply be forwarded to the NVC which will only touch to forward it to the appropriate embassy. Once the I-129F gets to the embassy then other fees may be required but only if you persue the I-129F for a K-3 visa (which is not desired). Otherwise, if the embassy does not recieve any correspondance from the beneficiary then the I-129F will eventually become outdated and invalid. The I-130 on the other hand will require certain fees to be paid directly to the NVC.

That was a short term scenario from last year. Both petitions have been routinely forwarded to NVC for nearly all of 2008.

Facts are cheap...knowing how to use them is precious...
