Hello,

I wanted to ask this question. My ex fraudently married me for a green card back in 2007. We married in 05, she got visa in 07, not even two months she went to her lovers home, and cleared joint accts, safe, etc. I as a US citizen field for divorce adn divorce was final in Oct 07, I let it go and moved on with my life and remarried this past year overseas and petitioned for my new wife field I-130 and I -129F

My question is

1) will my ex win her green card during renewal in 09 as filing for good faith

2) Will I have problems for my new wife visa, since I did not do fraud

Your ex will be petitioning for removal of her conditions in 2009, and will have to provide proof that she married you in good faith back in 2005. She can self-petition if you're divorced. They might be contacting you to see that she did, at which time I suppose you could tell them you believe she didn't.

I don't believe you'll have any problem with your new wife, as long as you meet the criteria which is that you're divorced at the time of the new application.
