Hi everybody,

I'm currently married to a US citizen. My wife has submitted the K-3 visa application just over three months ago and currently waiting.

We got married in Los Angeles. I currently live in the UK.

I'm planning a trip to see her in November for two weeks and I want to know if I can travel on the VWP program?

Will the customs officer know if a application is process

Do i also still fill in that green form that is given to us on the plane?

Can anyone give me any ideas if this will cause any problems?

Thanks

Hi

You can travel to US when your case still pending. It is up to the immigration officer if they let you pass or not. I visited my husband for 3 weeks ago in US and I have a K3 visa pending. I had brought with me all proofs that I plan to go back to Sweden after my visit. I had bring with me letter from the work that I had vacation and are a permanent worker, my paper for my house and vacation house, a round trip ticket, bank statement from Sweden and and.. I passed the immigration officer without any questions. I have now a new ticket in December because I want to celebrate Christmas with my husband in US.. Good luck..

My husband tried coming on his visa waiver and was denied entry. You have to be careful. They may send you right back home.

Can you give us more details about that please?

I've been let in every time (7 times) and told them I came to visit my boyfriend or fiance (once engaged).

I didn't even know this could be a problem until I found VJ and read some of the posts. Now I'm terrified that the next visit will be the one I'm denied for. A lot of it depends on how often you visit and how long you stay for.

I think you have to fill in the green form still, as it's for immigration and customs. You're not a US citizen so I would fill it in. One of them about what you have with you, and one about your intentions/background.

When he came they asked him why he's coming. He said "To visit my wife"...that was the end of that!!! LOL

I hear alot of people say "To visit a friend" and they have no problems...

However, once you get assigned an A#, I heard that it will pop up in the computer with customs...don't know if they can see it and then deny you based on that. I really don't know...and immigration is never EVER uniform...they do things differently for everyone!

When was that and what port of entry? What passport was he using? Had he visited before? What happened once they denied him, they took him somewhere for questioning? They told him he cannot come any longer? Did he have any documents to prove that he wanted to go back home? I visited 3 times without troubles..

Port of entry was Washington DC. He has a Netherlands passport. He visited several times before. They held him for 30 hours and questioned him. He was then left to sleep overnight in their holding cell and sent back home the next morning. He was treated like a criminal. Actually there were 2 officers. One was Hispanic and one was a redneck white guy. The hispanic one asked him how long he would stay, etc. He then stamped his passport "admitted" and said, "Okay, you can enter." The white guy said, "No" and took his passport, wrote "void" on the stamp, and said, "I'm not gonna let you in." The two officers argued amongst each other and then my husband said, "I'll just go home, I don't want any trouble." Then the redneck guy said, "Ok" and then took my husband to a holding cell and brought all these agencies to question him, etc etc etc. He was treated like a criminal. My husband holds a Netherlands passport, but he's Muslim...enough said.

That sounds awful.

To be fair though, what does his religion have to do with it? It's not like they know he's Muslim unless they ask him, and they wouldn't need to do that. Plenty of people have been sent away, regardless of religion.

Considering saying boyfriend myself, except I've said fiance a few times in the past and don't know if they have that on file. Plus I don't want them to drag it out of me that we're engaged..

Just to let everyone know that I got into the United States without any problems. The immigration officer was a very nice guy...

He asked me the following...

Q. What's the purpose of your visit?

A. Pleasure

Q. How long you staying for?

A. 18 days

Q. What will you be doing here?

A. At this time i think when he scanned my passport he saw the K-3 app in process. I replied i'm here to spend some quality time with my wife. He then stamped my passort and said "welcome to the United States"

As long as you are honest, you'll be fine. So good luck to those who are planning to travel the states :)

I travel to the Netherlands every 2 months. Everytime I come home they ask me the purpose of my visit in the Netherlands. I say, "I was visiting my husband, while we're waiting for immigration to process his case" They ALWAYS say "why? he's from a visa waiver country" Then I tell them my story and they say, "Oh yeah...well, if he said 'wife' then that's probably why."

They know my husband is Muslim because on his passport it says the country of birth. From that they can derive the religion...also, his name being Ajmal. LOL And just to clarify, his religion WAS an issue, because the redneck agent made comments about where he was born and then brought in those lovely government agencies with 3 letter acronyms to question him for 30 hours.
