Can my cosponsor have a pending K1 petition?

Does anyone know if my co-sponsor can also have a pending K1 petition? We have both been approved within the last 30 day's. My consulate is Manila his is Guangzhou. On top of that he is my employer. Will this be OK?

It will not matter, provided that he has the assets to support his petition and your co-sponsorship.

It will not matter, provided that he has the assets to support his petition and your co-sponsorship.

Assets are not required. It can be income and/or assets used to qualify.

It will not matter, provided that he has the assets to support his petition and your co-sponsorship.

Assets are not required. It can be income and/or assets used to qualify.

So to say assets are not required is not quite correct - assets MAY be needed in ADDITION to income dependant on wether the co sponspor earns enough income to support his own petition AND the OP's.

My understanding is that if the co sponspor has enough income to cover both petitions he need not show assets - if he does not have enough income he will need to show assets to make up the shortfall.

Hence "and/or". Assets are not required. You don't have to have any assets at all if you have enough income and if you have no assets and not enough income, the co-sponsor can use income only, assets only or a combination of income and assets to qualify. The requirements relate to income. Assets can be used to offset an income shortfall, if needed.

I suggested assets (combining income and other sources of $$$).... I suppose I could have been more specific, but it was 1:51 am....
