Can I file for EAD before I file for the AOS

Hi everyone.

I'm just out of Social security office. I'll have my card in a few days. by then we'll be already married. Just wanna ask can I file for the EAD (I 765) before I send the I 465 for the Green card?

May 21st 2006: Entered the USA on a K1 visa

July 2nd 2006: Marriage ceremony

Oct 10th 2006:Received Green Card

REMOVING CONDITIONS

August 12th 2008: Sent I 751 to CSC

Dec 5th 2008: Green Card in the mail

NATURALIZATION

Dec 4th: Sent N 400

March 18th: Interview

May 24th 2011: Oath in Minneapolis. Journey is over.

I think you'll need to file your EAD concurrently with AOS or after you have filed for AOS.

You need a basis for work authorization (EAD) which is the AOS in this regard.

Yes, you will have no basis for filing for an EAD until you file for AOS. So file both together.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

You can, but it's usually an exercise in frustration. The EAD that will result will expire when your 90-day authorized stay in the US expires - if the application is processed that quickly.

She can file a c6.

Yes, you will have no basis for filing for an EAD until you file for AOS. So file both together.
