Removing Condition with divorce

Hi guys i have some questions , i would like somebody help me , iam removing condition through divorce and i have a lot of evidance , my question when i will file how long it take ? and i will get 1 year extention right ? do i have to go to the immigration place to get stamp or they will mail me automaticly 1 year ? thank you guys i appreciate .

You can file anytime after you are granted your conditional residency if applying through divorce. You will get your NOA1 - extension letter a few days after to a week - once application is receive...usually a week after...Your extension letter is good enough - you don't need to have a 1551 stamp unless you wanted to...

  • NOA1 - 1 year extension..................................08-26-2008

You can file anytime after you are granted your conditional residency if applying through divorce. You will get your NOA1 - extension letter a few days after to a week - once application is receive...usually a week after...Your extension letter is good enough - you don't need to have a 1551 stamp unless you wanted to...

Hi Bulanglang , thanks for ur reply i do appreciate ur advice , how long it take to get aproved for the 10 years green card ? cuz i hired a lawyer will file for me , and i got a lot of evidence , we bought a house and vehicle together and have join taxes 2006 and 2007 , bills , wedding pics , vacation pics , do u think i have enough evidence ? and the top of that why i divorced her she like to go to the bars and drink a lot and she said that she cheated on me . i cant live with somebody liar . thanks.

Well it depends. Sometimes it'll be less than 6 months or it'll take longer, nobody knows. you'll receive the same NOA's like the "regular" filers and will go through the same routine, file, bio's, wait etc...you don't need to get stamp as long as u have the extension and have filed accordingly. some of us including me got RFE for more evidence...Best of luck.

Just like you said you have lots of evidence you could provide. Since you are hiring an Attorney he/she will help you all the way. Just submit what you have and take it from there. Read again the 751-I instructions especially on the evidences you need to submit. I submit a personal letter explaining what happened to my marriage - as to why I had to file on a waiver...

you need to submit evidences that you lived together and also , as you are filing thru divorce, you will have to submit evidence that she abuses you or cheated on you ...etc..then , based on your evidence they will make a decision ..

There is no need to provide any evidence of abuse or infidelity, it is not required at all. You just need to prove that you entered the marriage in good faith and not for immigration benefits.

Correcto.

Just be sure to include enough evidence that shows a financial comingled life e.g. tax returns, bank accounts in both names...btw for the checking/saving accounts make like a history of your account...like one for 2006, other for 2007 and the most recent one before your separation or divorce, something like that.
