hi everyone....

I took my behind the wheels driving test yesterday, and I passed. But the dmv personnel said that they cannot issue me a true driver's license other than the temporary license printed on a paper because my K1 status will expire in 30 days. She further said that I have to give them the extension notice of my status here in order to get my true driver license or else it will expire.

I am already married with my USC petitioner and we'll file AOS next week...

My question is...Is there a thing as proof of extension that I can submit to dmv? Where and how can I get it?

sorry but our case is different u filed K1 and i went thru CR1, i and my husband went to Idaho transportation department, and since i got my Philippine drivers license that i have just

renewed it with my husband's name on my birthday before i left they honor it, and i can drive here for 90days,(actually my husband let me drove yesterday)then the lady their just gave me a book for me to review for my written exam

and i also used my driver's license,passport and social security number as identification and requirements for a bank account here.......

Some states will not allow a K1 to take a test until they have adjusted status, and I guess the reason is that they dont want to issue a temporary licence.

I have not hear of an extension. maybe someone else can give you info on that.

Once you file for AOS/EAD and have the NOA1, that might be sufficient evidence to extend your drivers' license for another period of time. Each state is different, but in Virginia the NOA1 was all they needed to have.

I THINK, IT VARRIES IN EVERY STATE. WE WENT TO DMV MARION COUNTY, TENNESSEE I SHOWED MY INTERNATIONAL DRIVING PERMIT AND NON-PROF PHILIPPINE DRIVER'S LICENSE AND THE WOMAN THERE TOLD ME I CAN DRIVE FOR 90 DAYS BUT IF I GO THERE (DMV) A WEEK WHEN I ARRIVED THEY WILL ALLOW ME, BUT NOW THEY DON'T? I WAS CONFUSED WHAT IS THE DIFFERENCE? MY DL AND IDP ARE STILL GOOD AND NOT EXPIRED. I WAS BUSY WHEN I ARRIVED TALKING AND GETTING TO KNOW MY NEW FAMILY. I ASK HER IF I CAN TAKE MY EXAM MAYBE ONE OF THIS WEEK SINCE I HAVE MY PHILIPPINE DL, AND MY AOS WILL BE SUBMITTED THAT TIME VERY SOON, SHE JUST TOLD ME THAT THEY NEED A 4 MONTHS OLD BILLS (PHONE, CREDIT CARD, WATER, ELECTRIC, ETC.) AS A PROOF THAT I WILL STAY HERE IN TN, BEFORE I CAN TAKE THE EXAM. SO MY HUSBAND PUT MY NAME IN THE BILLS THAT THEY NEED, LUCKILY I'VE GOT MY SSN SO WE DON'T ANY PROBLEM OF PUTTING MY NAME ON THE SAID ACCOUNTS AND ALSO TO THE BANK ACCOUNTS OF MY HUSBAND.

As eevryone has noted, every state's dmv is different. In Kansas, it is my understanding that a valid visa with a I-94 card is sufficient to recieve a DL, however, its validity expires when my I-94 expires... To extend/renew my license, they accept an I-766 card (EAD). I've read that other states only require an NOA1 from an AOS application (i think it was Wisconsin (?))... check California's dmv website. the info was readily available on Kansas' DMV website.

I'm bored, can't sleep and am moving to the US on Thursday!! whooo hooo! I found this in Cali's dmv FAQ section (URL: http://www.dmv.ca.gov/dl/dl_info.htm#BDLP)

Note that they accept an EAD, I-797 (approved NOA2 for AOS, i'm guessing it's an NOA2, not the NOA1), I-94 and I-551 stamp. I believe, in your case, you will receive the EAD first and it is that document they want in order to extend your DL (EAD = 12 mnth validity). You'll have to renew it again when you receive your NOA2 (if valid for 24 months) or GC. You'll have to return once your gc expires and you receive your 10yr gc, and maybe you'll have to return the year after that if you become a citizen...

But I may be wrong as conflicting experiences trump whatever I jsut said.

I guess you need to go to homeland and security office and ask for the extension of your k-1 visa or Form I-94 rather you really have to wait until you receive a paper from them regarding your EAD/ap or AOS papers. :hehe:

Why Do You Need to Extend Your Nonimmigrant Status?

A nonimmigrant temporarily enters the United States for a specific purpose such as business, study, or pleasure. When you entered the country as a nonimmigrant, a U.S. immigration inspector should have examined your passport and visa and then given you a Form I-94 (Arrival/Departure Record). This record should tell you (in the lower right-hand corner) when you must leave the United States. You can prove you did not violate U.S. laws by turning in your Form I-94 to the proper authorities when you leave the country. If you want to extend your stay in the United States, then you must ask for permission from the US Citizenship and Immigration Services (USCIS) before your authorized stay expires. Proof that you are willing to obey U.S. immigration laws will be important if you want to travel to the United States as an immigrant or nonimmigrant in the future. If you break immigration laws, you may also become subject to removal (deportation).

What Does the Law Say?

The Immigration and Nationality Act (INA) governs the admission of all people to the United States. For the part of the law concerning temporary admissions to the United States, please see INA § 214. The applicable regulations are found in the Code of Federal Regulations (CFR) at 8 CFR § 214.

Who is Eligible?

You may apply to extend your stay if you were lawfully admitted into the United States with a nonimmigrant visa, your nonimmigrant visa status remains valid, and you have not committed any crimes that would make you ineligible. You must apply to extend your status if you wish to stay longer than the date indicated in the lower right-hand corner of your Form I-94 (Arrival-Departure Record). Please note, you must submit the application for an extension of stay BEFORE your current authorized stay expires. You must also keep your passport valid for your entire stay in the United States.

You may not apply to extend your stay if you were admitted to the United States in the following visa categories:

(VWP) - Visa Waiver Program

D - As a crewman

C - As an alien in transit or in transit without a visa

K - As a fiancé of a U.S. citizen or dependent of a fiancé

S - As an informant (and accompanying family) on terrorism or organized crime

How Do I Apply?

For the following categories of nonimmigrants, your employer should carefully read and file a CIS Form I-129 (Petition for Nonimmigrant Worker) and any supporting documentation:

E - International Traders and Investors

H - Temporary Workers

L - Intracompany Transferees

O - Aliens of Extraordinary Ability

P - Entertainers and Athletes

Q - Participants in International Exchange Programs

R - Religious Workers

TN - Canadians and Mexicans Under NAFTA

If you are in the following nonimmigrant categories, you should carefully read and complete USCIS Form I-539 (Application to Extend/Change Nonimmigrant Status) and submit any required supporting documents:

A - Diplomatic and other government officials, and their families and employees.

B - Temporary visitors for business or pleasure.

F - Academic Students and their families

G - Representatives to international organizations and their families and employees.

I - Representatives of foreign media and their families

J - Exchange Visitors and their families

M - Vocational Students and their families

N - Parents and children of the people who have been granted special immigrant status because their parents were employed by an international organization in the United States.

The application and correct fee should be mailed to the USCIS Service Center that serves the area where you are temporarily staying. If your nonimmigrant category is work-related, then the application and correct fee should be mailed to the USCIS Service Center that serves the area where you will work. How Do My Spouse and Child Apply to Extend Their Stay in the United States?

If your employer files USCIS Form I-129 (Petition for Alien Worker) for you, then your spouse and child must carefully read and complete USCIS Form I-539 (Application to Extend/Change Nonimmigrant Status) and submit any required supporting documents to extend their stay. It is best to submit both forms at the same time.

If you are filing USCIS Form I-539 for your own extension, you may include your spouse and any unmarried children under the age of 21 in your application if you are all in the same nonimmigrant category. You may also include your spouse or children in your application if they were given derivative nonimmigrant status. This means that your spouse and children were given nonimmigrant visas based on your nonimmigrant status. For instance, if a student is given an F-1 "Academic Student" visa, then the spouse and child are given F-2 "Spouse and Child of an Academic Student" visas.

When Should I Apply?

We recommend that you apply to extend your stay at least 45 days before your authorized stay expires, but the USCIS Service Center must receive your application by the day your authorized stay expires.

What If My Authorized Stay Has Already Expired? (What If I Am Late Filing for an Extension?)

If you are late filing for an extension and your authorized stay has already expired, you must prove that:

  • The delay was due to extraordinary circumstances beyond your control;
  • The length of the delay was reasonable;
  • You have not done anything else to violate your nonimmigrant status (such as work without USCIS approval);
  • You are still a nonimmigrant (This means you are not trying to become a permanent resident of the United States. There are some exceptions.); and
  • You are not in formal proceedings to remove (deport) you from the country.
How Can I Find Out About the Status of My Application?

How Do I Get Another Form I-94 "Arrival/Departure Document" If the Original Was Submitted With the Application to Extend My Stay?

If your application for an extension is approved, you will be issued a replacement I-94 with a new departure date. If your application is denied, your original I-94 will be returned with a request for your immediate departure.

How Can I Appeal?

If your application to extend your stay is denied, you will receive a letter that will tell you why the application was denied. You will not be allowed to appeal a negative decision to a higher authority. However, you may submit a motion to reopen or a motion to reconsider with the same office that made the unfavorable decision. By filing these motions, you may ask the office to reexamine or reconsider their decision. A motion to reopen must state the new facts that are to be provided in the reopened proceeding and must be accompanied by affidavits or other documentary evidence. A motion to reconsider must establish that the decision was based on an incorrect application of law or USCIS policy, and further establish that the decision was incorrect based on the evidence in the file at the time the decision was made. In Oklahoma, a K-1er either gets a DL based on showing the EAD card (which means that the DL is only valid for the length of time the EAD is valid), or based on showing the green card (which means that the DL is valid for a normal period of time). Showing the NOA1 for AOS or getting an extension (which I don't think exists as an option for a K-1) is not sufficient. Sounds like your state has the same rule.

Based from the answers here and your situation, I guess it depends on the State where you are.

Im here in Florida and didn't have problems with my license after I passed the actual driving test. Same day, they changed my learner's permit into an official driving license although it was marked temporary because it was still in my unmarried name pending my AOS approval but I got my DL anyway . They did inspect my passport and saw that my I-94 has expired but I told them I was already married and presented our marriage certificate.

Maybe you can go back and talk to a supervisor.

Hi! I read your post and noticed that you too are in Florida. My fiancee just received her K1 and will enter the U.S. soon. In your experience, were you able to drive before receiving your Florida driver license, for example, by using an international license? Waiting several months for my fiancee to be able to drive seems impractical. Thanks in advance!
