Edit: I-129F Petition Approved....but still no hardcopy?!?

Hi all,

Our K1 petition was approved by VSC USCIS on Oct. 23 but I have still not received the NOA2 in hardcopy. I have, however, received a letter from NVC saying that they have "... recently received an approved I-129F petition filed on behalf of your fiancé." It goes on to say that within a week the petition will be forwarded to the Moscow embassy and that my fiancé will soon receive a packet on how to apply for the K1 visa, etc.

My question: What should I do about this NOA2 which seems to have gone MIA...? When I call the USCIS office in VT I just get the automated voice saying that it's been approved and there's nothing further that they can do. Huh?!? I know I am supposed to forward this NOA2 notice to the Moscow embassy and to my fiancé in order for our case to "officially" begin (I am, right?).... So.... is there any way to have another hardcopy sent to me since it seems this one has been lost in the mail? (I have checked with the post office, etc...there's nothing). Is there another number I can call where I can actually talk with a living human being? Anyone in a similar situation?

hi. i dunno if we have the same case but sounds like kinda.

but with ours its our RFE. website said they sent it, and we didnt get any. and we called and called. and they kept saying the same thing - that it was sent. but after two months of nothing they apologized for the "inconvinience" and sent another one. which we got in a week.

so two months delay.

the thing i would have to share is keep calling and make sure its office hours at the VSC so u can talk to an agent. and when you do, get her/his name and tell them to note it down that you called. our case was put on abandoned file cos they said we never called but we did. so please tell them to make note that you called and get the agent's name everytime you phone them.

we have the exact problem as you, except we were approved on 23rd sept at csc. we have phoned a few times first time they told us to wait 30 days second time advised us that we need to fill out a form requesting second hard copy and book an appointment (that form costs $340)

i posted on here for advise and last night we tried the rfe trick. cos we have no proof of failed delivery, we never had email or anything from uscis about approved petiton the first we knew was nvc letter. well last night i think i cant remember cos the signal cut out on the net and i was listening but i think they are putting a service request in to update our case because it still says recieved and pending. :unsure: and i think that means they would end up sending the noa2 again (or is suspect they never did before so first time :angry: )

I will have to ask Vito when gets home about what they said properly. though i think we are as confussed as each other :blush:

thought i would add that when ever we phone uscis we have to tell them we are approved and how we know because they dont see it at all. i guess at least they can see your approval on the phone.

Ach! How strangely frustrating! Wonder if there's something about the 23rd... I feel your guy's pain.

I guess I am going to keep researching some info (I read something about getting it if you sign up for an InfoPass...?). If I find anything worthwhile, I'll definitely let you know! There is NO way I will pay a $340 because of a faulty postal delivery or whatever it is. Sounds like a nice scam to me ... :blink:

You will need to contact USCIS as you will need a copy of the approved petition (I-797/NOA2) for AOS.

How do I contact USCIS and speak to actual human being though? Is this even possible?

Could the Bureau of Consular Affairs letter that I got regarding our *approved* case having been received by the NVC, suffice in lieu of the NOA2 for my fiancé's K1 app./interview? I mean, it says on the website our case is approved, the automated phone operator says it's approved, NVC says it's approved... Maybe I should contact the embassy in Moscow or something about the situation? I know we need the noa2 for AOS, but perhaps I could worry about that later after Vasya's K1 visa is (hopefully!) approved! :P

You don't need to forward the NOA2 to Moscow but you will need it when you file to adjust status.

Thanks everyone for your advice. I actually called USCIS (Vermont) last Monday. THe woman was very courteous and helpful. She said that my NOA2 had been returned to them as "undeliverable" because my apartment number was not written on the address. So stupid. I thought the mailman knew who I was and also USCIS sent a previous letter to me (WITH the apartment number on it) to confirm an address change I had had to make... so... stupidness on both ends but not on mine, thank god.

Anyways, the USCIS agent said they'll send me another one out aSaP - free of charge. Should receive it tonight or monday i hope.

If you haven't received your NOA2 yet, you should really call USCIS and confirm with an agent that they have your correct address. Also, you should check with your local post office and the post office headquarters. They can give you a tracking/confirmation number you can use to find it. Somehow when NVC sent me their letter (without apartment number) I got it ONLY because my buildings front desk manager saw my name on the envelop and told the mailman which box number to put it in. The postman was just about to mark that one as undeliverable as well. So this goes to show, that the problem can lie with an individual postal officer, a USCIS officer, or even your buildings management.

I have same problem..CALL & Call.to USCIS..not reply new they never mail me NOA2..still not have it . Mine was approved on 10/31/2008................**F**..VSC..not working there...lots of Vj's they Haven't yet NOA2....
