Hi

Since my husband and I haven't heard anything regarding our case since our bio appt in march we called our congressman to see what was up. Since I live in Louisiana, New Orleans offices have been closed since the hurricane. My congressman informed me that they will be reopening the New Orleans office in June. However it may be another 6 - 8 months before they can get to our case. I was informed by one INS officer that we could wait untill our AOS interview was approved. The "conditional" greencard would allow me to work and leave the country to go home. Our congressman stated that this was not true, that I would need to apply for a EAD and that the EAD would forward onto my greencard so that I would not have to renew it all the time.

Is this true?

The only reason we haven't filed for the EAD and the AP is because my husband went back to school and we couldn't afford it. We can now, but we have agreed that if I want to wait till the aos is approved to work we can still swing that option. If not, we can still apply for the ead/ap. It's just I really want to go home and see my family.

An LPR, with or without conditions, is employment authorized and in normal situations for most people can re-enter the country without issue after travelling abroad.

See and that's what I "TRIED" to tell this lady, but she told me that I had to apply for a ead and then its transfered to the greencard when I am deemed a "lpr". So what you are saying is that I don't have to apply for a ead. (Since me and the hubby already agreed that If I don't want to apply and work I dont have too)

If you are not an LPR and want to work you need EA and an EAD to prove it.

If you are an LPR and want to work you do not need an EAD because you are EA by virtue of being an LPR and you have a Green Card to prove it.
