New K1/K2 rules you didn't know

We finally called the help line today to find out what is going on. It turns out that things really aren't the way the law says:

I explained that we were filing to lift conditions on K1/K2 green cards that were issued simultaneously where the Mom and daughter (15 at the time 17 now) had arrived together. We seem to have been passed over and wanted to know if she could get any information for us.

The lady had terrible English so I confirmed with her about 10 times what she was telling me. I kept asking to the point that she accused me of arguing with her and told me that I could wait as long as I chose to wait we weren't going to get the cards.

According to her:

One I751 application and fee gets one green card. Adding another name to the application whether it be a K2 or anything else makes no difference. You will never get a second green card on a single application with a single fee. There is not enough information to issue a green card for the second applicant on the single I751. She said she knew this to be a fact because she has been getting tons of phone calls from people that have the same problem. She said that was the problem with our case.

I tried to explain the law and she said it didn't matter what the law said. We would not get the card until we sent a second application and fee for my stepdaughter.

I'm sure glad I have VJ. This lady almost had me believing her. Where do they find these people?

Yep - the people who answer the phones are not immigration staff - they are call center staff. The only way you might be able to get half way decent information from calling is if your call is escalated to an Immigration officer. That means that the person who answers the phone puts you on hold and transfers you to someone who actually works in Immigration. Follow the written instructions that you have received from USCIS and don't rely on spoken information from the Mis-information Line.

It really set her off when I asked to speak to somebody else. The more questions I asked the angrier she got.

I really don't think this lady had a clue what K1/K2/Conditional Residency or any other USCIS terms meant.

I got a letter from my Senators office today. I called Friday but the guy that is handling this was on vacation. The letter says they have sent an inquiry to USCIS to find out what the problem is. The guy is supposed to call me on Monday.

Got a letter from our senator yesterday. I think they are lying to him also. His office said that USCIS sent them a letter stating that the application was being processed. This would be strange since they haven't even cashed the check yet. Maybe they feel so bad they are doing it for free (LOL)

They finally cashed the checks!!! Maybe something will happen now after 6 months of fighting.

We fianlly made some headway today. My wife got her bio appointment for 18 December and my stepdaughter got the letter that says she can stay here for a year and the bio is coming.

hopefully they will get the same bio date, which I doubt. We have 6 hours one way to drive so we will all go together and beg if they get different dates. I can't believe this whole ordeal has lasted for almost 7 months so far.

If you both have biometric letters, then go together. As long as you go with your appointment letters they don't usually care if you show up early. Try to find out which days have the lightest work at the biometric center. The whole thing will probably be over 15 to 20 minutes after you arrive. So, plan on doing other things after the appointment. Go early in the day if possible.
