new to the whole procedure

hi all, i just got married in philippines on may 26, 2006. i'm a USC. i came back to the US on may 28th and mailed the I-130 on may 29th. here are my questions:

1) we got forms from the US embassy in manila but noticed the exp date above has already passed. will this be an issue?

2) according to the I-130 instructions, one of the requirements said a copy of the marriage certificate. but i notice on this site that a certified copy was needed. i sent a photocopy of the original certificate. is this still valid?

3) what i'm planning on doing is once i get the first NOA for the I-130, i will send the I-129f for the spousal visa. is this the quickest method of getting my wife here? also seen the CR-1. i've read stuff about it but still a little bit confused. i've read that the CR-1 was the only option prior to K3 visas. should i apply for both K3 and CR-1?

4) i noticed on some users' signature "touch". how can i do this? what will i need or where do i get updates?

5) are they really ####### about "none" and "n/a"?

6) from data on this site, the average time for K3 to processed is 4 months, correct? what is the average time for I-130? the embassy in manila told me 3 months for the whole process but somehow i don't think it sounds right

1) Probably not. Check the USCIS web site to find out what versions of the forms are acceptable.

2) Photocopies (of good quality) of documents are appropriate for submitting with petitions and applications.

3) Good question - read the IMBRA thread in the K1 forum.

4) no comment

5) USCIS can be particular. For the most part the USCIS does not ask questions that are not applicable, and on the other side many applicants do not understand what 'not applicable' really means.

6) See the answer to question #3.

Number 5. I used both none and n/a, withought any subsequent problems.

For number 6. I guess anything is possible, but that does not seem too likely. I don't know about Manilla, but it seems like most K3's take a minimum of 5 months from start to finish.

thanks to all the response. i read one of the IMBRA threads and tried to read IMBRA itself - how i love reading info on laws - "Section 1.3 of Paragraph 8 states that Document 8 only applies to citizens that qualify under the ####### Act". :huh:

well when i submitted the I-130, not only did i submit proof that i'm a USC but also included a copy of my passport and pages with immigration stamps that showed i visited philippines twice in the last 5 months. hope that's enough to get me by IMBRA, if it even affects that document.

wow, 5 months for K3? and that's after i received NOA for I-130? looks like i'll be planning another trip. hats off to those who are patient. it hasn't been a week since i last saw her and i'm goin' nuts. canada and mexico relationships are lucky, you can just cross the border. wish philippines was glued on to california :blush:

Technically you are going for both. First past the post. K-3's came about to reunite couples quicker when CR-1 immigrant visas were taking years to obtain. CR-1's are now almost level pegging in many cases.

The IMBRA does not affect I-130 petitions only K visa petitions I-129F fiance & I-129F spouse.

Probably. If she's applying for a tourist visa, she'll need to prove that she's not planning on immigrating to the US. Filing the I-130 (for the CR-1) is proof that she intends to come to the US and live there.

Will it affect your application for the petition? I don't know.
