Hi, is it okay to apply EAD first before that AOS? Is it possible or I need to apply them both at the same time. I just want to find job right away and my prospect employer were looking for my EAD... please enlightened me with this matter. Thanks

Timeline:

2-02-08: Honey arrived in Manila

2-04-08: travel down to my hometown, Zamboanga

2-07-08: Our Engagement day

2-27-08: 1129F sent to CSC

2-29-08: NOA1

3-02-08: first touch

7-11-08: 2nd touch- APPROVED!!!!

7-14-08: received email from CRIS that our petition has been approved July 11'08

7-16-08: received hardcopy of NOA2 in our mailbox

7-23-08 hard copy from NVC

7-28-08 paid delbros for DV

8-19-08 medical (LORD, pls. keep me physically fit)

8-27-08 Interview, got pink slip, praise God

9-05-08 received my visa, had my CFO the same day

9-06-08 flight to US, POE LAX

11-08-08 wedding day

11-12-08 ssn application under my husband's name

02-26-09 sent AOS packet to Chicago Lockbox thru USPS Express

02-27-09 recieved & signed by V.Bustamante

03-05-09 cashed check

03-09-09 AOS, EAD, AP received

03-12-09 Biometrics appointment notice recieved

03-28-09 sked for boimetrics, 2pm,done

04-13-09 received letter for initial interview sked 05-13-09

04-23-09 AP received

04-27-09 EAD received

05-13-09 passed GC interview, my status online says GC production ordered

05-19-09 Welcome letter received

06-24-09 Green Card receive

02-13-11 Lifting of Condition

02-09-11 ROC package sent

02-18-11 recieved NOA, waiting game

Applying before AOS will be under category A ( 6 ) and the EAD card will expire with your I-94 (you won't even get it before the I-94 expires, on or about 12/05/08 for you). Applying with AOS will be under category C ( 9 ) and will result in a one year EAD card.

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

In this case without the I-485, they would no longer be eligible to apply for one, and therefore it would be simply denied.

meaning, I should apply both at the same time so my EAD will have it's 1 year expiry.... thank you for such a quick reply 'payxibka'

Wish I had known about this! I applied for my EAD on my K1 and now my K1 has expired and I have been denied working authorization! Very frustrating! I recommend just waiting and filing with your change of status application!

what if u came on K3 visa and applied for EAD, how long is that valid? also 3 mos only?

TIMELINE: K-3

9/21/07: I-130 received at Chicago

1/3/08: I-130 NOA 1

1/16/08: I-129 NOA1

9/15/08:approval of both I-130 and I-129F

10/4/08: received letter from USEM to schedule for interview

10/16-10/17/08: husband passed medical

10/28/08: i went to my husband's interview (pink slip) but more requirements needed from NSO a repeat of CENMAR and MC, marriage index w/ CDLI

11/4/08: husband hand delivered additional docs to USEM; waiting for consul to review it

11/14: consul reviewed docs

11/19: i received letter from Senator stating that husband's Visa approved.

11/20: visa released to delbros

11/24/08: visa in hand

11/26/08:husband flew to Georgia

working permit

12/1/08: sent via USPS to VSC

12/8/08: NOA 1

1/22/09: approved

1/28/09: received EAD card

AOS

7/13/09:AOS package sent via USPS

7/15/09: received at Chicago Lockbox

7/17/09: check for $1010 cashed

7/21/09: NOA 1 for AOS received

7/27/09: biometrics appt notice scheduled for 8/19/09 3pm, atlanta service center

8/19/09: husband's biometrics done

9/26/09: AOS interview approved: waiting for the 10 yr green card

10/7/09: green card received

2012: apply for citizenship
