Hi all,

So given the speed at which USCIS is now approving the petitions I noticed my petition was not going anywhere... People who have filed after me have received thier NOA2 with approval.. SO, it started to make me ponder and wonder... Hence, I called the USCIS call center and got my generic bla bla bla message...

I asked my senator that I just wanted to know where my petition is in the process.. He inquired on my behalf to let me know that my background investigation is still open and thus my I-130 and I-129F is being "delayed" per USCIS and they stated not to inquire for another 90 days.

Anyone going through this?? Anyone know how long this takes??? Does the FBI do this?? What triggers lengthy delays??? Religion?? I know i'm still in processing timeframe.. but just reading some of the USCIS horror stories makes me quite nervous, so please shed some light if you will. I'm a pretty straightforward person who was born and raised in the US, never been arrested... etc.

So anyone who has some experience or knowledge please shed some light, as I'm getting nervous that they will wind up taking forever like some horror stories...

In my case background check took over 6 months. But i think they try to work faster now.

As I found out at the interview, what happened that somehow in there system there were another person with the same name, last name and date of birth as mine.

Timeline:

07/05/2006. Married in Anniston, AL, USA

I-130

02/06/2008. Mailed I-130 to Chicago Lockbox

02/08/2008. I-130 delivered to Chicago Lockbox. Signed by V BUSTAMANTE

02/20/2008. I-130 NOA1 date. Vermont Service Center

08/26/2008. Touched. (I-130 transferred to California Service Center)

08/27/2008. Touched.

08/28/2008. Touched. (This case is now pending at the office to which it was transferred)

08/29/2008. Touched.

09/26/2008. Touched.

09/27/2008. Touched.

10/16/2008. Touched.

10/17/2008. Touched.

11/12/2008. Touched.(Senator inquired on case status. Case with FBI. Was told not to inquire again for 90 days)

Wow Azer your's took a long time... I really hope mine does'nt wind up that long... I talked to my dad's friend today who is a lawyer.. he basically also stated that although no one admit's to it, it probably is stuck in background investigation because of my name and being muslim...

I hope it get's resolved soon.

Thanks again.

Hi kaus&Sanu, I am exactly in the same boat and it has been 13 months since I applied I-130. I am told it is in background checks. I contacted congressman's office and they told them the same thing and to check back in 90 days. I truly hope you petition is approved as it has been very long time. Can you tell me how long it took? Did you do anything else that helped pick up your case ? Thanks.
