I'm not sure exactly what to ask here, but I believe I have read posts where the AOS receipt was used for evidence of something. Is having the receipt, which shows that AOS has been applied for, useful for any other process such as driver's license, etc...? I'm asking because my fiance's I-94 will expire on Dec 10 and at that time he can no longer work or drive a car. Would the AOS receipt be proof of anything related to the aforementioned or would we have to wait for the greencard/EAD in order for him to continue driving & working? I'm pretty certain he wouldn't be allowed to continue working, which is fine, but I'm more concerned with driving.

Thank you all in advance.

Hi there. I read in here that it depends from state to state. LIke for example here in California their strict with that. I believe I read like it should be at least 60 to 70 days before the I-94 expires that one can apply for driver's license. IN my case, I waited for my EAD (work permit) to at least apply for Driver's License. Anyways, I think if you know the DMV number there or if DMV is near to your place there's no harm in asking. Also if he have a Driver's License from other country I think they have special instructions for that. GOod luck

We had to apply for his ID, but was turned away because they said that his I-94 had to have at least 2 months validity because they had to run a check of his documents with immigration. At that time, he had only 6 weeks left I believe on his I-94. I replied that they were incorrect and that what they were telling me made absolutely no sense. I also said that it should not take longer for the DMV to check his documents than it took for Social Security to check, which only took 1 week. I left with the phone number to the Indianapolis DMV and called on my way home. I was told by Indianapolis that he had to have a least 1 month validity on his I-94. I called the local branch and told them that I was just in their office and was turned away and that I had contacted Indianapolis. I informed them that we were on our way back in to apply for his ID and did not want any problems. We returned and applied for his ID, which we received in the mail the following week though the local branch tried to tell me it would take 2 months to receive. His ID expires on Dec 10.

Since he didn't have a license from his home country, he applied for his learner's permit in which we were turned away again, but that time I did not leave and made them call Indianapolis. He was able to take the test that day. He received his learner's permit in the mail, which also expires Dec 10. In Indiana, you have to keep your learner's permit for 2 months before taking the driving test to acquire a license. His permit will expire before the 2 month mark. Though it may seem futile to have fought to get his permit, it does allow him to drive with me at least until Dec 10. Then we have to start the process over again once he's eligible.

In my original post, I was wondering if having the receipt for AOS would allow him to have his ID or permit extended.

I was told by California DMV in here that the state ID or Driver's license will expire on the same expiration date that you presented to them which on your husband's case for now is his I-94. The notice for AOS is of no use for them, I did that too here in CA, they wanted some legal documentation with expiration date on it.
