I did the i-130 and we just recieved our second notification.. everything is going well. But I think I was supposed to send I-129f package too, right? Was I suppsoed to send that after the first notification? I dont remember reading it in the instructions or in the 1st NOA :S

If that is the case then I should hurry and send it quick~!

Anyone know how much this is going to screw up the process?

My wife has already come here before and has her alien number and SSN too.. I doubt that is really going to be any help

Yes it was supposed to of been sent off after you received the NOA1. With an approved I-130 you only have perhaps 2-3 through NVC then interview. The I-129F could take a little longer then usual now because of the IMBRA. The NBC processing date is currently stuck at March 5 so you could have a longer road through there then your I-130 through NVC. Its up to you though if you wish to see which one gets to embassy first. We procrastinated a little after filing I-130, were completed in 42 days so decided would go for the CR-1 and save the money with the K-3.

eek, ok still a little confused... so if I dont file a 129f I have to file a CR-1? CR-1 is for being able to work when she arrives?

I think I need to go research what exactly the 130 and 129 are... it has been so long that I basically forgot. It took us 6 months just to get the 2nd NOA for the I130. Looks like we will have spent our entire first year of marriage sperated :S

I think you're right - you need to figure out what you're doing, starting with learning to distinguish between petitions and visas.

To hit a few relevant highlights, it is not necessary to file an I-129f petition and apply for a K3 non-immigrant visa - that's an optional parallel path to the I-130 petition and immigrant visa. Since you're I-130 petition is already approved, there's unlikely to be any benefit to you for starting that parallel path at this late date.

An immigrant visa gets your wife Permanent Resident status on entry to the USA and all of the benefits that status entails, including employment authorization.

d'oh! Well, reading through the website again things are making sense. I misread it at the begining and thought I was supposed to send the I-129f after the second notification. I didnt realize I was supposed to send it at the begining and compete with the I-130 to see which one finished faster. The I-129f would have been finished 2 months before the I-30... or is it 3months. Anyway, wife and I am feeling a bit bad about this.

So now that I understand this- I see that we are doing the CR-1. At this point in time it probably would not be advantageous to submit a I-129f.

Now I just need to read and find how much time we have left.

When we did the K-1 Visa everything seemed to flow a lot smoother.

You might want to reconsider the I-129f if your I-130 is not yet at the consulate.

The wait times for an immigrant visa (CR-1) are close to one year, currently. I would not expect them to get any shorter in the coming year.

Wait times for the I-129f (K-3) are much, much shorter. Find the Juraez thread in the Regional Forums.

except now with the addition on IMBRA no one knows how long K3s are going to take. It may well take over a year as well.

Might as well just wait on the CR1.

Yes, I did a K-1 and got married with my wife here in USA. A family member got sick and we flew to mexico the same day without filing the correct papers to leave.. anyway.. now we have to do the K-3 process and me and my wife feel like we are being punished for a family emergency.

As soon as the new 129f comes out I will start that process.. I can't believe all the ####### that good people have to go through while the illegal immigrants get to come here and party, cause problems, and mooch off of everyone.
