Stan, you're giving incorrect advice.

Some people DO get asked for evidence of returning, especially those that have circumstances different than yours. (more visits, longer stays, stated other reason for visiting..)

Russell Brand is a celebrity entertainer. He was denied because he had a criminal record, and obviously applied for a waiver or work visa that took another few months. Amy Winehouse was also denied entry to the US due to drug use and had to file for something similar.

Also, you will not be turned away at POE when using a K1 visa... try reading many other posts here and you'll find that being denied entry before on the VWP has no bearing on the K1.

ALL that i was saying and i will stand by it is that no matter what VISA you have there is always the possibility of beeing sent back. Its still a case by case thing.....

Yes, I understand what you were saying.. but the OP was asking about the impact of being denied entry on the K1 visa and it would have none at all.

It's not the same as using the VWP or a tourist visa and it being up to the officer; a K1 guarantees entry as long as it's used within the timeframe and you do what is asked.

I stand by Stan because I asked one of the officers and I have experience to counter your statements.

Even with a perfectly valid visa (B1, H1, L1, K1, K3's... visas fit that definition), YOU CAN BE DENIED ENTRY! There is no guarantee whatsoever.

It's up to the officer at the POE to make that decision. I am not saying he/she will, I am merely saying they can.

If you don't insult them, joke about terrorists/bombs/etc... or carry illegal stuff, there is no reason for them to deny you entry. But anything that according to their guidelines will make you look suspicious is basis for denial. So don't wear that "I hate Bush" T-shirt :)

Just answer questions with very brief and neutral statements.

By the way, any entry denial has MAJOR impact. Ask people who had to request another visa after a denial!

And your comment "you'll find that being denied entry before on the VWP has no bearing on the K1" is INCORRECT too.

Ask my fiancee who went through a grueling K1 interview if her entry denial on the VWP last year had no effect ! How come 10mn out of the 12mn we spent in the interview was about the entry denial, even if the interview was supposed to be about us being together! How come the officer at one point said" I will give you one last chance to get your K-1 visa...".

The question here is: "Was anyone ever denied entry on a K-1/K-3 visa at the POE?" And maybe the answer is 'no'. It would be interesting to have statistics.

October 5, 2006: We meet for the first time!

March 8, 2008: I-129F K1-Fiancee Visa Application mailed

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

I remember reading stories on here of K-1 visa holders who were denied entry at the border because they found pictures that looked like wedding photos--if they have any suspicion that you are already legally married, they can deny entry on the K-1 visa and require you to start over on the K-3. Not directly related to the OP's question, but perhaps relevant nonetheless!
