That depends - is the USC on he child's birth certificate? Was the birth reported to a consulate/embassy? Does the mother give permission?

As the minor child of a US citizen parent, the child would be classified as an Immediate Relative. The process should take 9-12 months. USCIS has lots of petitions to go through.

I noticed that you are adjusting your status. Lots of people have the I-130s ready to go on the day they take their US citizenship oath. If there are bits of information missing, USCIS will ask for it later. This locks in the priority date.

Good luck.

Thanks aaron2020. My question is actually for my father.I have a younger sister and I just want to know, how long to process the petition. Another question, when I become USC and I petition my mother, can my younger sister go with her since she is a minor child?

No, your sister will not be able to go with your mother. Your mother would be in the Immediate Relative category which does not does not allow for derivative beneficiaries.

You as a USC can petition for your sister in the F4 category. A wait for a visa there is 22 years for the Philippines.

Alternatively, your mother as a LPR (green card holder) could petition for her daughter in the F2 category. The wait for under 21 years old is 4 years and for over 21 is 11 years. Age is determined at the time a visa is available. How old is your sister?

Kokobear,

Since you said the child is now 17 yrs. old you need to hurry up the process before she turns 18 otherwise it will take a long time to process the papers once she is over 18.

I thougt 21 yrs old and not 18 is considered adult in petitioning on a minor child. She is only 13 now. I was just saying 17 because that will be her age when my father would become a USC. I am just waiting for my citizenship interview now. Once I become a USC,I will petition my mom and once she come over here as an immigrant, she can petition my younger sister? And only 4 years to process? That's cool.Thank you for all the responses
